My friend has a XB12R that has been in the shop more than out, its an 05 and its had wirering harness problems, cylinder probs, shifting issues, and more. Some of these things have been repetitive and some were just impossible to find until other stuff was eliminated. Its had two cyl swaps, one motor swap and I'm not sure what else, so Mr. Court, whats a guy to do?

Wayne:

Lemon Laws, like some other laws, vary state by state. Not only do the laws vary but interpretations and procedures, written and unwritten, vary widely.

Lemon laws, in my view, are like concealed weapons in that their greatest value is sometimes having someone else just think tucked away to level the field.

There are some non-consumer friendly by-products of these intended to be consumer friendly laws. Tread with caution.

My PERSONAL suggestion would be a visit (read the thing I wrote a couple years ago about dealing with dealers) with the service manager or dealer principle. I'd ask them to arrange a meeting with the Buell S.O.A.R. (Service Operations Area Representative) to review and discuss the issues and resolution. I, again PERSONALLY, would try to keep focused on the positive....getting a reliable motorcycle that I can enjoy, rather than the negative. Any litigation tends to be negative...it's the way the system is created.

Buell has a history of being very good to work with on these types of things. Even with quality and reliability at an all time high (for the INDUSTRY) they realize shit happens and I've yet to see them deny responsibility in a case where it's warranted.

Here's a summary of the state Lemon Laws but you'd have to check to see how up to date it is.

The other thing, again PERSONALLY, that bothers me about going the legal route is hiring someone who makes $250-600 an hour to sort out a $6,000 motorcycle.

I consider it a blessing that my attorney has her published on the internet rate set at $600 an hour. . it makes me think very carefully before sending her work. Others should be so lucky.

All the best and let me know if I may help.

Chiming in on Lemon Law. I dont want to have it go through legal mumbo jumbo. I just want my bike BACK in running order. Failing that, I want to be cashed out so I can take any equity I have and move onto the XB12STT. My bike has been in the shop now for 32 days. Normal parts delay, I can understand (why? because every part for this bike has always been 7-10 days away) But this is pushing the limits. I am suffering from severe separation anxiety here and missing the best part of our very short riding season. I have burned through our techs, and my service manager. The regional Harley Tech rep will be in tuesday, I am hoping to get resolution there, barring that, what is my next step?

i can surely sympathize with you my 07 xb12scg was at the dealer for 6 weeks for a cold start issue and a lean pop cold or warm .the dealer was clueless and so i waited while they told me story after story.i contacted hdb and they told me that tech support was involved,i would get calls at work to tell me that they found the problem and the part is on order but to no avail so i researched nj lemon laws and fired off a letter similar to one on the web site stating my intentions and that i was within my rights to file lemon law.hdb called me and told me that they had
been on the phone with the dealer trying to get the issue resolved.they replaced my throttle body and sensors and told me it was fixed.when i picked up the bike the timing cover was missing the front rim was scrached and the muffler dented.oh by the way i still have the same issues.wed 7/11 at 8 am i have an appointment with dano a buel feild technical rep
at my dealer.i feel your pain
