Bought my 2005 CityX from a guy in Tennessee last month. I live in North Carolina. It was on Ebay, and I made an offer to end auction early. Went out and picked it up, paid in cash and have the bill of sale in hand. They mailed me the title to the bike, but when I took it to the DMV they informed me that the folks had filled it out incorrectly. The name on the front of the title isn't on the back, but the dealer that had it put their name there instead. However the dealers name isn't on the front of the title anywhere. The DMV told me the only way to correct it is to have the dealer and the original owner do two different power of attourneys to "make the title right". My problem is that I can't get the guy to mail me the papers. It took me a while to get ahold of him aswell. I did find the original owner's phone number via savvy internet skills and will be calling him to see what the deal is. The tags on the bike expired just this month and I have about 10 days left in NC to drive it "legally". I know one option is to do a title bond, but I have NO clue how to go about doing that. Another option, if I can get the original owner on the phone, is to have him apply for a lost title, and just get him to fill it out right I guess. Ugh what a mess. Anyways, just thought I would post this and see if I can get some more information on what my options are. | ||

Before you jump through hoops, take it to another NC DMV office and see if you get the same answer. One person's "unacceptable" is often another's "perfectly legit". Hopefully, you'll find someone who can handle this simply and easily. | ||

I was kind of thinking that same thing. Don't shower for a couple days, eat something really really nasty smelling, and go in all hot and tired looking. But be as sweet and kind as you can possibly be. And pretend to speak the language poorly, or act like you are not that bright and fairly helpless. Maybe bring in a kid with you. And a kitten. Give the kid a teddy bear, and have him ask "Dad, please let me ride the new bike before my big surgery!" loudly. And make the kitten look sad. It's a fairly straightforward excercise in social engineering, but the DMV is about as tough an audience as you would ever come up against... | ||

Hopefully, you'll find someone who can handle this simply and easily. We have run into the same issue here in eastern NC. One DMV is great and helpful and you can actually get in and out in a reasonable amount of time. However, one town over, the DMV SUCKS. They are not helpful and down right rude. I hope you get your title issue worked out. Come on over to Carolina Corner Carvers and introduce yourself. Looks like we just picked up another Bueller in Winton-Salem. | ||

contact the person whose name is PRINTED on the front of the title, and ask them to sign a request for a replacement title. do the right thing and pick up the form yourself, and fill in everything you can (VIN, year, model, owner's name & address, etc.), and leave as little as possible for the owner (er...the person named on the front of your title) to have to deal with. pay the filing fee yourself, and ask them what brand they drink, and bring them a basket of cheer for their trouble. this is typically the fastest and easiest way to do it: forget the copy you have, start fresh. | ||

I don't really see how a different DMV clerk could/would tell me anything different. The printed name on the front isnt signed/printed anywhere on the back like it was supposed to be. | ||

Trust me DMV clerks will give you the run around, they don't even know their own rules. When the Little Kid went to get his cycle endorsement, after passing the Motorcycle Safety Foundation class(a requirement for all those under 18) they gave him a Temporary Instruction Permit! Their own rules prohibit anyone under the age of 18 from getting a Temporary Instruction Permit! I had to take him back and show them where they screwed up, and they didn't even acknowledge they were the screw ups! If you have a Bill of Sale, and a title that is clean they can jump title, all you have to do is come up with a good story and stick to it. I work with the DMV in my state all the time and they are just human and sometimes fail to use common sense and let their emotions get in the way. I was with a friend who was trying to get a title in his name for a car his crack head step daughter had bought off some one without a title and left in his driveway. He started talking and the DMV clerk finally told him "Don't say too much, you're getting your title" | ||

Thunderheart- you state that you posted this thread to see if you can get any information- instead of posting that you don't see how using a different clerk would help, why not simply TRY that excellent advice... In both my local DMV, and many DMVs in NYC, and certainly the DMV in Santa Clara, Ca., different clerks can, and do, make entire;ly different determinations. Much like police officers, they exercise a broad latitude in interpretation when determining the legality of a situation, and their own ensuing action. If you post asking for helpful intel, don't question the plausibility fo that intel- instead, try it out and cross your fingers! best of luck- Jay | ||
