A WARNING!
The dealer (Cerini HD) installed a race ECM on my brand new XB9S before I even saw the bike to buy it.
I bought the extended warranty for the motorcycle.
The ECM went bad.
Cerini tells me the extended warranty will not cover the race ECM. In fact Harley's Service center tells me if anything else goes wrong with the engine they may not cover it.
I was sold the extended warranty when I bought the bike. I hadn't asked for this race ECM, It was already on the bike. I assume now the money I spent on the extended warranty was wasted.

New bikes don't come with race ecm's. Race ecm's are not covered under any warranty that I am aware of. Harley's "service" center will try any angle to get out of doing warranty work. Extended warranties are a third-party deal, HD has nothing to do with it.

HD has nothing to do with it.

Not sure about that... I got the extended warranty when I bought my bike and it came with a card (like a credit card) that says Harley Davidson all over it.

I also got the tire coverage, and when I went in for a new tire (after getting a nail) they called Harley to confirm the number before doing the service.

My extended warranty is from Harley Davidson. They said the dealer should have not sold me the warranty if they had already installed the race ECM before they sold me the bike.

New bikes DO come with race ecm's in them. We installed several Buell Race Kits on bikes before they were sold. Sold several bikes BECAUSE they had the race kit already installed on the sales floor.

It's up to the dealership.
I bought mine with the Race Kit installed.
The only warranty coverage I needed was a stator replaced, no problem.

If your referring to Cerini's in Union Town, PA, they are the worst dealer I have ever dealt with. Completely incompetent. Go somewhere else!

They have had the bike for over a month now.
Called today said it was fixed. Called back said they put the wrong ECM in, would have to order the right one.
I reminded them when they first ordered the parts that it had the race kit.
Service manager said the would make sure. I guess he was just talking out his a--.

Seriously, cut your losses, get your bike out of there. You can take to any Buell dealer, it doesn't have to be Cerini's.

It seems like an unfair business practice.
Buell sold me a brand new Buell with Buell parts. Agressively sold me an extended warranty that doesn't cover the bike they just sold me.

Jack, once you get your bike back, don't go back.
You don't have to go to that dealer to get warranty service done.
Any Buell dealership can do warranty work.

New bikes DO come with race ecm's in them

When you install the race kit, you are technically voiding the warranty, so in effect by installing it, the bike is no longer technically new.

Printed directly on the ECM is "For Racing Use Only" and the pipe is engraved with "Not For Road Use" and a long disclaimer.

These are not stock parts, and therefore are NOT covered under the warranty, extended or not.

Stock ECMs are covered by both the factory warranty and the Extended Service Plan (It's not a warranty, it's an insurance policy against mechanical failure, hence the deductible). If a dealer installs the race kit, they are impacting the factory warranty along with Extended Service Plan coverage. This should have been mentioned before the ESP was offered; however, other mechanicals are still covered like transmission, suspension, stuff like that.

Here's what the Buell/H-D disclaimer reads as far as performance parts:

"Race Application Only

CAUTION: Engine-related Performance Parts are intended for the experienced rider only. Buell® motorcycles modified with some Buell® Pro-Series performance engine parts must not be used on public roads and in some cases may be restricted to closed course competition. Throughout this online catalog all engine related performance parts identified with the race flag symbol are intended for racing applications only and are not legal for sale or use in California on pollution-controlled vehicles. Alterations of emission related components constitutes tampering under the US EPA guidelines and can lead to substantial fines and penalties. In other words: YOU ARE A GROWN UP. ACT LIKE ONE.

WARRANTY: Installation of Buell® Pro-Series products, and similar products from other manufacturers, except some street-legal offerings installed by authorized Buell® dealers, may affect your Buell® limited vehicle warranty. See your dealer for more information."

Now, that being said, did the dealer try to work with the motor company to try and resolve this issue? Sometimes an empathetic phone call can go a long way. I know it's worked for me on several occasions.

NOTHING is printed on the ECM that came on the bike other than a number.
It was brand new bike, I bought off the dealer's showroom floor.
I knew nothing about different ECMs. I didn't ask that a different ECM be installed.
I bought the extended warranty in good faith that this brand new bike would be covered.
I should have been informed that the dealer had voided the warranty by installing the race kit.

Old_man,

This dealer could be in violation of Federal compliance laws, for knowingly installing performance parts on your bike. Then selling the bike to you for use on the highway.
You might check with Pennsylvania DMV or your state's version of Air Resources Board.
I'd be willing to bet there are stiff fines involved for a violation.

Bottom line, they'd do well to get you fixed up right and hope you don't turn them in.

Through the help of Court, Buell will take care of the problem. It will cost me $100.
But everyone should be aware of the consequence of the race kit.

Old_man, if your ECM doesn't have "race use only" on it, then it must be a very early model. It is my understanding that only the very early units were not labelled. Is the bike in question the 2003 model in your bio or did you get a new one?

Also, what muffler came with the bike?

I'm glad you came to a satisfactory resolution. Sounds like they're giving you a new ecm at dealer cost perhaps.

Old_man, I feel for ya. Just another Buell customer being screwed by a dealer, and needing the help of Mr. Canfield to straighten it out. I'm sure the dealer knows as much or more about the situation than Court, yet his influence is required to get them to do the right thing.

When are the dealers gonna learn what "Customer Service" is, or even to just stop thinking of us simply as marks?

NO NO NO!

Buell did not sell you this bike.
Your DEALER sold it to you. BUELL delivered the bike to the dealer STOCK and that is what is covered under the warranty.

Do not say "Buell" screwed me.
They did not, your dealer did.

It is the bike in my Bio, early 2003. It had the Latus muffler installed by the dealer before I bought it.
I never said Buell screwed me. I know who screwed me.
But that said, The big sign says "Buell"

Ok, that explains why the ECM is not marked. Mine isn't either, I bought it in October 2003. But, even though its not marked, the warranty is pretty clear.

Most dealers seem to have their heads where the sun doesn't shine. Mine tried to sell me the extended warranty too, I told them to get bent. I got a letter from them about a year later explaining that I would have to go somewhere else if I wanted service.

Based on what I know now about your situation, I'd say you fared very well considering it's not a warranty item. I'm glad someone came out ahead for once!

wow i thought my dealer sucked until i started reading badweb...i have it pretty damn good....when i bought my bike they upsoldme the factory race kit....therefore it was their responsability period....as far as i was concerned....ive had problems with the place i bought my bike so i took it somewhere else when it fouled a plug...never once did they question the fact that it had hot plugs in it or a race kit they just did the work and gave me back my bike with a smile...id expect nothing less from any dealer....some of ya'll have some serious dealer problems that should be addressed at the factory level....man i think i should go apologise to the dealer that sold me my bike ..they werent so bad all things considered....personlay i expect the same kind of service i get from my car dealer at a harley dealership.... meaning good ,fast , friendly, and helpful. anything less is unexceptable.

be very thankful you get that kind of service from your car dealer. Last time I took my car in it took like 4 phones calls to them, 2 to factory and 1 to the BBB to get them to do warranty work. They did it though, and it hasn't been back since.

well like any business there are good ones and bad ones.....i kinda thought harley had a tight reign on crap like this though...i wonder if the 30,000 dollar cruiser people have these problems.
