Perhpas the helmet could have made a difference?? Posted on Mon, Apr. 18, 2005 Man dies after motorcycle strikes dog on I-26 A motorcyclist from the Asheville, N.C., area died over the weekend after his Harley Davidson struck a dog on I-26 in Newberry County. Randy Joel Rugh, 45, of Fairview, N.C., became the 10th motorist killed this year in Newberry County, authorities said. Rugh was pronounced dead at 10:50 p.m. Saturday at Palmetto Health Richland hospital in Columbia, but the accident happened at 3:30 p.m. Friday, Newberry County Coroner James Smith said. Rugh died of head injuries, Smith said. Sheriff Lee Foster said Rugh is the 10th person to die in accidents this year, far more than in recent years. The Highway Patrol said the dog ran onto the interstate as Rugh drove a 2003 Harley toward Columbia at the 75 mile marker near exit 76. The speed limit in that area is 70 mph, patrol spokesman Steve Sluder said. Rugh, of 23 Laynette Drive, was not wearing a helmet, Sluder said. Rugh was thrown onto the emergency lane on the right shoulder of the interstate. The dog also was killed. | ||

hmmm, I believe NC has a helmet law so I guess I'm kind of surprised that it says he wasn't wearing one unless this town/county is right on the SC border as I don't believe SC has a helmet law. | ||

Sounds like he was in SC (which doesn't have a helmet law). Newberry County is north of Columbia, which is the state capitol. | ||

I am not trying to be funny, but what if he were riding a Buell. As I have been lucky enough to dodge two different dogs, I remember thinking that if I were on a bike that didn't handle so well, I might be picking myself up right now. Just a thought | ||

Dog owners responsibility! There is a legal obligation here, to keep your animals under control. That's anything upwards from dogs, to horses, pigs, whatever. Cats for some reason aren't included, even though some cats are bigger than small dogs. There are further, stricter, rules for what you'd call Interstate type roads. Dogs also should be tattooed inside the ear for ID purposes in just such cases as this. Dunno what the rules are there, but here my dog causes an accident, I'm liable. | ||

A woman in my club hit a goat. Totalled her CBR, broke bones, resulted in screws in her shoulder blade I think. So the looked at sueing the farmer for not keeping his stock penned up but I don't think he had anything, no insurance, so... When she hit the goat the bike nose dived and summersaulted. Pitched her down the road. She was wearing full leathers. | ||

Could be wrong here, but some places, Nevada comes to mind, if you hit a cow/horse it's your responsibility to find the owner and pay for it..  g u s | ||

Yeeup, here in MT you can pretty-much drive as fast as you want, providing you're "safe and prudent." That means if you're going so fast you can't miss that poor defensless cow you're not very prudent or safe. So you total your outfit and still have to pay for the cow. Deer however, cost nothing to slaughter and maim w/ your vehicle. Rob | ||

Okay, just to complicate things here, if you hit a WILD animal, such as deer or boar, even a pheasant, you are NOT allowed to take the carcass (assuming it's dead & you're not) however anybody coming along behind you is perfectly entitled to pick it up. Weird or what? If you happen to go to India, be very careful, cows are SACRED, lord knows what deep doodoo you'd find yourself in if you hit one. | ||

In New York they passed a law about 10 years ago that states that if you hit a dog or cat and do not make a reasonable effort to locate the owner (I'm presuming this is at or near the scene of the accident) you are committing a felony. Strange huh? |
