Justices (should) know the 2A inside and out. Personally, if *I* were one of them? I wouldn't stand for it. Carry at work, and make it KNOWN you do. If you have the ability...CARRY. Seriously. I get the feeling Durham didn’t want to convict this guy. Why didn’t he strike jurors until he had no strikes left then request a change of venue based on the fact that there were no impartial jurors available? Maybe he just wanted to get certain people on the stand. | ||

That lines up. Those were attempts at for-cause dismissals. A judge can deny those. Peremptory dismissals are not for-cause. I wonder how many they struck peremptorily? There’s a limit. Still, why not petition for a venue change? | ||

The problem was, the lawyer couldn't just reject jurors because they were fans/donors to the unindicted co conspirator. Not unless he wants to spill the plot of the story he's telling ahead of time. A true story, sure, but he had to prove it in court. I'd love ( sarcasm ) to see a brutally honest request for change of venue. "I'd like this case to be in a different town where most of the jury pool isn't foolish or evil. And an honest judge would be a welcome change."... If they can prove the jurors lied, though? |
