With BSA set for a comeback, I wonder who holds the rights to the names Lightning, Cyclone, etc. Mike http://www.motorcyclenews.com/news/2016/october/ma hindra-acquire-bsa-motorcycles/ |

I believe Harley Davidson still owns all the copyrights associated with Buell, but it was stated here several years ago that HD corporate lawyers had been instructed not to expend any effort protecting those copyrights. |

No one does. According to the USPTO they are abandoned. I'd have to check those two, specifically, but I don't think Harley-Davidson "protected" any of them. http://www.badweatherbikers.com/cgibin/discus/show .cgi?tpc=32777&post=1582541#POST1582541 |

So let me get this straight - instead of an EBR 1190SX we could have an EBR Lightning or a Buell Lightning? Even the folks who rebuilt Triumph from the ashes were smart enough to keep the names "Triumph" and "Bonneville" instead of naming the new bike the "Bloor 900SX". We love you Erik and we love your tradition. I want to buy a Buell Lightning. Take your name back before Mahindra does! Mike |

So Buell is no longer trademarked? |

Not technically. But, common law may still give HD rights to it. I don't think it'd be too terribly hard to steal it, especially if Erik were to attempt. http://www.yospinlaw.com/2015/05/18/can_i_register _or_use_a_dead_trademark/ |

These bikes deserve names. I hate alphanumeric soup. |

You can actually purchase 'Buell" T-Shirts from cafe press: http://www.cafepress.com/+buell+t-shirts?utm_mediu m=cpc&utm_source=msn&utm_campaign=279016404-d-m&ut m_content=1234751561713417-adid-77171974505374&utm _term=kwd-77171979681557 I don't believe that would be possible if HD cared. |

I checked and EBR is offering a "Black Lightning" right now so maybe I spoke too soon. Lower gears on the SX, runs 10's in the quarter |

My advice - if you are seriously interested in using trademarks owned or previously owned by Harley-Davidson/H-D Michigan, LLC, you should consult a Trademark attorney. Second, contact Judy Henslee at H-D (if still around): Judy Henslee Mgr., Global Brand Protection Harley-Davidson Motor Company 3700 W. Juneau Avenue Milwaukee, WI 53208 trademarkenforcement@harley-davidson.com HDMC-TrademarkEnforcement@harley-davidson.com Depending on your intent, you might also contact the licensing department: 3700 W. Juneau Avenue Milwaukee, WI 53208 (414) 343-4218 licensingdept@harley-davidson.com |

You can have whatever you want if they have been abandoned. Harley-Davidson, and I'm not so sure it wasn't Judy or that fellow she worked with . . . pretty much publicly announced. . . under the "Wandell Doctrine" that not a dime would be spent on enforcement. In addition, these things need to be maintained. They didn't get "DEAD" just cause someone in Washington has a sense of humor. My bet is that if you make 4 bikes you will edge ahead of LAP in manufacturing numbers . . . Could happen . . . . but, I'd wager there isn't a mountain of interest in a 10 year old design . . .as gifted as it was . . . at the price point. I could be wrong. If you are looking for some fun . . . . take a read of Ruling the Root: Internet Governance and the Taming of Cyberspace by Milton L. Mueller. You'll find Judy quoted on page 237. If you meet her, be certain to ask her about putting the brakes on the sale of Harley-Daivdson coffins. |

I don't know about "Cyclone" but I would THINK these guys hold the rights to "Lightning" as far as it pertains to motorcycles: http://lightningmotorcycle.com/ |

This article is in French, but nowadays it's easy enough to get it translated: http://www.lerepairedesmotards.com/essais/motos/li ghtning-strike-prototype.php This is the interesting line (translated, of course):
quote:Hatfield has had to pay fees to Harley-Davidson for the use of the name Lightning Strike which was registered in the name of the deceased Buell. "It's more than I wanted to pay well, but not as much as I feared!"
