This was posted to EBR's Facebook page shortly after noon EDT today:
quote:The sale of EBR assets has now been scheduled. It will be done in a bidding process on July 21st between a number of potential buyers at an event managed by the receiver. Then all bids are subject to court approval, scheduled for July 23rd. Looking forward to moving ahead soon!

Was wondering what was up. I know the 'time frame' was up......too bad. |

Not necessarily "too bad". The point of this sale is to keep the company intact if possible. |

As much as I hate to say it ...... Had the receiver found any spark if interest in operating it as a going concern they would not have resorted to the auction option. I'd love to be proven wrong. |

The telling sign maybe in the Facebook post. "To be clear, this sale is not a selling off of individual pieces, but as it states in the court documents, it is selling off in large blocks as an ongoing concern sale" Selling off in large blocks doesn't sound like keeping the company intact. Considering comments made by EBR that they could be up and running in a day. |

The consulting business is a block.(2) The built inventory in various countries are blocks. The non manufacturing related tooling and fixtures are a block The manufacturing tooling is one. Spares inventory is one, and so on. Unfortunately its a bad time to be on the market. Either way I plan to ride my DeadHorse until the bearings fall out! |

SOP in bankruptcies is to take offers for the business whole, in big pieces, and in little pieces. Then they add up the offers for the pieces and see if they're higher that the offers for the bigger pieces and whole. |

Posted by EBR to their Facebook page last night:
quote:The brand name is in the lot of intangible assets and intellectual property. The assets have to be broken into segments like this by law, but it is a going concern auction and a number of bidders are coming with the intention to buy all the lots necessary to move the company forward again. The outcome is of course unknown, but it actually looks very good to us.
It sounds like Court could get his wish. |

Cross-post from the EBR sale thread on the Quickboard; this comes from an EBR dealer. He says this is the first correspondence they've had from EBR since the closure:
quote:Hello to all EBR dealers. Our apologies for the last months and all the uncertainty and business hardship that the closure of EBR created. The receiver and his team have worked diligently for a way forward and we are now confident all is headed in the right direction. It is likely that EBR will be under official new ownership as of July 23rd.

I think it's at 10 AM, but I can't find anything that documents that. The court hearing to confirm the results is scheduled for 10 AM tomorrow. My first thought was we'd have to wait until tomorrow before we hear anything, but they've gone ahead and publicized the Hero deal and it's contingent on being approved tomorrow, so maybe we will hear something today. |

So here is what I am thinking... Whoever buys the company will want to control the announcement and messaging. So EBR and EBR insiders really shouldn't be leaking any information. They should let the new owner have the privilege of making the announcement. One exception to this might be the receiver. But even they probably owe the new buyer, who is the owner at the instant they win the auction, make the announcement. The other exception might be a "official unofficial leak". Where information is allowed to leak because the new owners have a shred of compassion somewhere and are willing to throw us enthusiasts a bone and end our torture. Pleeeeeaaassssee!!!!!!!!!!

Bruce Belfer is: Owner, The Belfer Group, Inc. Greater New York City Area Electrical/Electronic Manufacturing And on Linked In, he is a member of: Independent Manufacturers Reps (Motorcycle Industry Only) He also lists "startups" as one of his linked in skills. So if this was the supplier to EBR for the very innovative solid state LED headlamps, and he has money to invest, and he had good experience working with EBR engineering... |

The LED headlights are made by Cree, an industry leader in LED lighting. I have had Cree LED downlights installed in the data center I work for. The Cree LED's are very nice, and made in USA. |
