I came upon this short article (http://www.jsonline.com/blogs/business/99900569.ht ml) about a possible Erik Buell street bike. The part I find interesting is that in the comments section it is mentioned that Erik is no longer held to a non-compete clause with HD. Does anyone know more about this?

In the Quickboard, under Erik Buell Racing teasing, Svh mentioned that during homecoming Erik announced that HD had lifted the no-compete clause in May.

Thanks for the info. So I wonder if Erik is working on the rights to the Rotax engine and will continue with either the current 1125 or 1190? It will be interesting to see what happens. Also, could a new line of bikes carry the Buell name? Maybe a new bike could have the Erik Buell name. I would think that HD cannot have rights to a man’s complete name.

At Sears Point in May the first race that the 1125RR competed in I talked to Geoff May and the guy who said he was running the team ( I do not remember his name) May said Erik was very motivated. The team manager said since the 1190 was never produced that it remained a prototype. Under Buell's contract with HD he retains all rights to his prototypes, hence probably why he will be selling the 1190 and not the 1125CR or RR. Besides those two are under powered for Superbike but, would be easy money makers. He said the 1190 was slated to be a 2010 bike. I assume that is why most 2010 bikes are 1125CRs and only a few1125Rs were made. The 1190 was suppose to be on the road months ago. It might be a sad blessing in desquise. If HD pulled the plug several months later with the 1190 in the production line who knows. As for Buell's name it is possible to own someone's name. Remember the artist formerly known as Prince. He wanted out of his contract but his record company had the rights to his name. I believe it was Sony. That is why he wouldn't go by Prince for years until Sony's right to his name expired.

there is a small peice in the november issue of cycle world on page 10. in short it says that the production runs will be small like bimota and ducati 1098r and that right now they are looking for investers and getting it set up.it also said that the bikes will have to have different parts and name because "harley retains ownership of many patents that list Erik as inventor". so the new bike Eric makes will probley be an 1190r wont that be fun!

Remember the John Fogarty/Sony suit? Sony owned rights to CCR, and sued Fogarty after "Centerfield" came out because he sounded too much like, well, John Fogarty. (Sony lost, but yes, you can own someone else's name, likeness, and apparently the way they sound). Remember H-D tried to patent the 'signature' sound of their bikes - they lost, too.

wHEN YOU GET DOWN TO BRASS TAX , pATENT LAW IS A JUDGEMENT CALL. Erik doesnt have to change the rotax engine as much as one might think to be considered a nw version or model . Eriks and Harleys rights to -models/versions can also be spelled out in different ways in a biateral contract between them. Something we, the public will not be privy to. A friendand myself have went through this with Disney ( yes , Mickey Mouse, Pluto ect ) We invented a new type of filtration system that could accelerate the Nitrogen cycle 100X its normal rate allowing the Fish, whales ect to be fed without the fear of over taxing the filtration system due to waste . Helmut ( My Buddy) thought that he had hit GOLDMINE ONLY TO FIND OUT THAT BY SHOWING DISNEY THE PROPOSED PLANS FOR CONSTRUCTION THEY RE WROTE NEW PLANS AND CHANGE IT ENOUGH TO GET AROUND PATENT.WITH FILTRATION WORKING AT SAME EFFICIANCY . DISNEY GAVE US 10,000 EACH AND WE TOOK IT KNOWING THE OUTCOME WOULDNT BE FAVORABLE .


SORRY FOR RUNNING ON LOL. ANYWAY IM SURE YOU WILL SEE ERIK WITH AN 1190 VERSION 3/4/5 ??? bUT THATS A good THING .

I've talked with a guy who worked for Disney in the past. He calls them "The Rat".

It will be interesting to see what emerges eventually.

John Fogerty was sued by Fantasy Records not Sony Records, and the song involved was "The Old Man Down the Road" not Centerfield.

Fogerty won the lawsuit, by the way.

Normally one does not use someone else's full name when posting a reply - the username is considered appropriate.

The intent of the post was to show an example of how these lawsuits are ridiculous, that's all - only to illustrate a point. Fantasy is correct. "The Old Man Down the Road" is a song on the Album "Centerfield". Thank you for the correction.

Erik Buell will probably not be able to call his next motorcycle with his namesake, because of former legal agreements with Harley-Davidson, Inc.

Maybe Erik could call the new bike the Famous Prince Saleen.
