I have only a few more patches if anyone is still looking for some - they sold pretty well on eBay and defrayed the costs so that all of us BadWeb brethren can get them at cost! I only paid for the Thor's Keeper's domain (for the patches) for a year and it will expire soon so I moved Thor's Keepers to Facebook (because it was easier). |

Very cool! Of course I know jack about facebook, how's that going to work? .......and does anyone know if we can copyright, trademark, etc., "Thor's Keepers"? |

I know jack about copyrights and trademarks so there we are. . . I think that we just need to insert a copyright statement/symbol on the artwork for that to be protected. I did get it registered as an officially recognized Buell group back when the owner's section of Buell.com tracked that sort of stuff so as far as the defunct Buell organization is concerned it's a registered name. I'll have to look into the trademark concept because my curiosity is up! |

OK, I looked into trademarks and they're not cheap. The application alone is $275. . . We need to sell a lot of T-shirts and stuff to drum up the cash. . . |

As I suspected, no registration is required to secure a copyright - just a statement of copyright which I have added to the logo section of the Facebook page. Of course, prosecution of copyright infringement would fall to all of us as a group if we discovered someone we considered a "non member" using the logo. |

The Cafe Press shop remains open and still has shirts, hoodies, etc. In thinking about the trademark I don't know how we would register it really even if the funds were available since we don't have an actual organization to register it to. . . It would have to be registered under one of our addresses and then changed as necessary. Might be a bit of a hassle long term. |

You could just register it to yourself. But what are you protecting from? How many people are going to try to make money from a logo from the working and not even real name of an entry level motorcycle from a small, and now closed, company? I think you have the market cornered as it is! |

I agree with you Andrew - not sure anyone will be looking to copy the name and logo. I placed a copyright statement on the logos around the interwebs and am pretty confident that we're OK. It's pretty much the readers of the Thumper forum that use it. The extra patches sold well on eBay but I did put them up for sale just after HD shut down Buell and listed them as "commemorative" which I think drove the business. So there are probably 40 patches out there that didn't go to Badweb members - but did go to Blast riders somewhere! The nice thing is that they sold for $5.95 so that we could get ours at cost. . . I have some left if you want to order any. Use the link at Facebook or on Thorskeepers.com to get the correct pricing. |

Through Erik? Me or Mr. Buell? I'm cool with it and would certainly donate towards it. True, I dont know that it is really necessary, but I would hate for our little piece of Buell history to be lost to someone who wasnt a part of it. Not interested in protection from someone elses profit, just its use. |

I don't know that Mr. Buell would want to own the Thor's Keeper's trademark since he didn't develop it or use it. I did send him a message to see if he would support the group - if even with a friendly "hello" - since there is no longer and official registry of Buell groups but I haven't heard back as yet. I think we're OK without a trademark for now. Outside of us, I don't know who would go searching for Thor's Keepers. |

Speaking as a lawyer, it would be nothing but paying out to attorneys to watch over it... and no money would be coming in. I wouldn't take it. To whoever made the thing: it is your property-- make a few bucks on it! On top of that it would be a gift to Buell... and I have a feeling Mr. Buell has plenty of money anyway. |

I'm not concerned with profits or the logo, just the name. I seriously doubt you could copyright or even stop someone using the fist and piston (hammer) as a logo. I like it, but its just too obvious. I've no delusion that it would become as commonplace as the 'Bar & Shield' logo or make any kind of real money. But every once in a while you've got to run an idea up the flagpole. Conway took it an ran it into an actual patch (stickers, shirt, etc.) which was very cool. I've just seen too many good names/logos usurped because they werent legally protected. I'm not a lawyer and know very little about such things, so I appreciate your free advice. |

To put it that way, considering the symbol, yes, I agree. It's a cool logo and I can see someone wanting to put some different words there. There is value there. |

No big secret - easily traceable just by closely following the original thread which backs up all legal concern with historical public and personal documents. Glitch - the creator - gave it to me to work with, because he was too busy with his current endeavors to follow up. I told Conway he was more than welcome to use and work with the original in the spirit of the original - representing Blastards - he's done a terrific job, and I back up his efforts - no one is going to coin a fortune off this design, and it has been freely available in different forms for Blastards to enjoy at fair prices. LOL - heck I wish I was rich - I'd get 1 of everything! - LOL EZ |

Again, just to be sure I made myself clear: Not worried about the money or the design/logo, just the name. FWIW: I think that would be the thing to protect. As you stated, protecting the design is easy (and I think it would follow the name, not visa versa). I'd use the "beating a dead horse" emoticon...but it doesnt work |

Wow. . . We've come a fair distance from my announcement that I moved Thor's Keepers to Facebook. I think that we've done what's necessary as much as possible to protect the name and artwork. I appreciate everyone's comments and zeal to protect our group name and logo. My emoticons work, so here you are Erik (no Russian porn here)! |
