There are undoubtedly some threads on BWB regarding this issue so please don't bash me for not looking them up. My problem is that I can't seem to get ANYTHING I order from the HD dealer where I purchased my Ully. Ordered a drive belt - never got it. Simple fasteners such as the one that the "HD Tech" (and I use the title loosely) forgot to reinstall after pulling my exhaust silencer. I fabricate a lot of my own stuff but there are some things I just can't make. I am wondering if anyone has filed or considered a class action suit against the Motor Company for not abiding to Federal laws and State statutes regarding parts support for vehicles that are no longer in production. If any of you know of any such action being taken, I would appreciate that info. |

Well, according to your post, your anything is just a belt, and some unspecified fasteners. The belt has, even when the bikes were in production, been on and off backorder constantly. The belts currently are on back order. I doubt you will have much luck with the class action, as there is no federal statues for this. For what its worth, I am yet to find any parts that I have needed to order were on any form of backorder. Only exception is a radiator pod, which took 4 weeks, but all bodyparts typically have a 1 month lead time, even before the closing. (Message edited by froggy on May 01, 2010) |

Generally get my stuff in a week. Some parts were actually in stock as far as nuts and bolts go - the kind you don't find at Ace Hdwe. |

I've had pretty good luck getting parts. They've had to order them but i get them within a week. Down town H/D Renton WA. |

+1 Wheelybueller! +1!!! I couldn't wait to get to the bottom of this thread to post 'what crap' but then I saw your 'excellent' response! The guy can't get a part so 'who can I sue'? I'd laugh if it wasn't such a damaging mindset.That &^%$#@, d_ _ b_ _ s mentality has helped ruin this country. |

In order to sue you need to have suffered some kind of loss or damages. Lets say my belt drive breaks (under warranty) and they remain on back order for the remainder of the riding season. (this could happen) Lets say I had to cancel a trip or rent another motorcycle. I could sue HD in Small Claims Court for the cost of the rental. Here in Ontario the SCC limit is 25K. Don't know if I'd win, but it would be fun. I'm sure the warranty has an out clause if they can't get parts, but it would still be some cheap entertainment. I would also have to give them an opportunity to mitigate, (get you a loaner) |

You're kidding, right? Have you tried a Badweb sponsor? What is the status on your belt order? They don't just "never show up" - you should have an order in the system somewhere. It might be on backorder...or it might be on the dealer's shelf and they just forgot to call you (it happens). And like Court said - find ONE statute that requires a manufacturer to support a discontinued model or brand. HD AGREED to supply service and maintenance parts for seven years; they are not REQUIRED to do it. And if the piece of hardware that wasn't installed was a screw to hold on the chin spoiler...it was probably installed, just without loctite (which is pretty much a requirement on the soft Surlyn bodywork because it allows enough flex to work the screws loose). Do some legwork. Try a sponsor. Belts are out there (I got one in March, in three days - .AKF revision). ...and let us know how your "lawsuit" works out. |

I hung my head low and closed my eyes in disgust the last time I drove through Atlanta and saw a billboard for http://www.whocanisue.com/ While hanging my head and closing my eyes in disgust, I rear ended the car in front of me. I went to the website to see if I could sue them for making me hang my head in disgust and distracting me while driving. |

As is often the case with posting something on this site, or many other sites for that matter, asking a question gets misconstrued and results in comments that make some appear, shall I say, a little less than intelligent. Froggy, I appreciate your feedback. Maybe its my dealership but along with the parts I have had problems getting (unfortunately a long list), my riding buddies have also had issues getting parts. As for support by HD , there are laws requiring this. (This is according to my friend who runs the Texas automobile and motor vehicle sales organization whatever...) I don't know the laws. Just questioning what I was told. Itileman, I agree about the Ace HW thing but the bolt I am looking for is an actual engine mount bolt so I am a little afraid of installing a typical store-bought bolt in this application. Wheelybueller, Buellerxt and Court, obviously have a problem reading the written word. I was just asking a f%#@ing question. Wondering if anyone "had filed or considered filing a suit". I didn't say I was was interested in filing a suit. I am actually the last guy to advocate filing lawsuits. Fact is, I am a board member for Texans Against Lawsuit Abuse and Citizens Against Lawsuit Abuse (a national tort reform organization). Lighten up boys! |

I ordered three items from a local Buell dealer this past week for my wife's 2008 XB12Ss. They had the spark plug wires in house. The air filter element hasn't arrived yet, and the drive belt has an expected delivery date of May 14. I don't know laws pertaining to parts availability, nor am I about to sue H-D. However, when parts get too difficult to obtain, we'll just have to look and see what bikes are on the market that Terri will enjoy riding, and buy one. We love to travel and go around corners briskly, so it will be a Sport-Tourer of some sort. It won't be anything currently offered by H-D. |

While suing the Motor Company is not the answer, some of us, as Buell owners, are tired of the whole Buell-being-shut-down situation. The back-orders have been real. Some are probably the result of slight panic hoarding (belts), others I don't know. I waited almost 4 months for an ETS. If supporting a Badweb sponsor is the answer - ask American Sportbike how long they waited also. If anyone has not had a part on back-order, great. If your Uly has been ultra reliable, great. Get back to me with how you feel if your bike sits for months waiting for parts, or if you cannot use the bike for fear it will leave you stranded. Again. I have had problems with my Uly for almost one year - problems that any dealer I have been to cannot or will not fix. There are several things that I am about to try. Replacing various parts and components until I find the problem. Why ? Because I love this bike. Unfortunately, I have gotten to the point where I really don't want to give HD any of my hard earned money. Money that should be going to the company I chose to support with my purchase. |

Thanks for the reply Florida_lime. Glad there are others out there who kind of feel like I do. I have had an engine go on me. (According to the dealer, a "factory oversight" during production of the engine) Otherwise, the other problems I have had are along the same line as a lot of the other folks here on BWB. Therefore, I try to be proactive when it comes to maintenance and replacement of parts such as the belt. I have tried other sources for some parts. When I paid for the drive belt, I was told by the dealer that it would take a week to get it. That's why I paid for it. Not being lame Blake. (Is that an insult from you?) Actually I think I was being rather diplomatic considering some of the comments fellow registered users wrote in response to, what I thought, was a simple question. I do appreciate those who have given me some constructive feedback. I really just wanted to know if some have been jerked around as much as I feel I have been by my dealer and Harley. That's what makes this forum worthwhile. } |

Nothing wrong with being upset about a new vehicle that you can not get parts for in a timely manner. If Harley did not want to provide prompt turnaround on parts they probably should not have been throwing around the 7 years parts promise at the time of sale. For those relying on their bike for daily transportation having to make other arrangements because their lifetime belt is on a 2 month back order have a right to be frustrated. The threat of lawsuit and frustration go hand in hand. 99% of the time its lip service from someone who's ultimate goal is just to get their bike back on the road. This is a note I sent to Harley about my Dealer This winter my wife and I bid and won a 08 Buell XB12XT on E-Bay that was in Texas, and had it shipped to Maryland. When the weather got above freezing we started racking up the miles. One day when we took a right hand turn at a stop light the bike stalled. In the next few weeks the bike started fouling plugs, and stalling all the time on right turns. Having been a life long Yamaha racer and rider I was rethinking the hole Buell thing. After hearing stories about Buell owners being treated like a "Red Headed Step Child" I took my chances and called Williamsport H-D and set up a service. Now my nightmare was real, I had to turn over my new baby to some grease monkey's at a Harley dealer.When I took her down to Williamsport I was invited into the cleanest shop I had ever seen. That is were I met Joe Hess a fellow Buell rider. He told me not to worry and I would get a call when she was fixed. I went home feeling a lot better about my baby. After lunch I wondered what I would do for the next few weeks as they solved my problems, then my cell rang. It was the service manager at Williamsport, your bike is ready for pick-up Mr Nicholas, I was SHOCKED! I called a buddy and got a ride to Williamsport were I had a great talk with Joe as he walked me thru the fix. Long story short, the Great staff at Williamsport Harley-Davidson has turned my Nightmare into a Racing Red Wet Dream. Now if I can just stop riding, to get my pulsing front brake fix I will be in heaven. Thank You for a Great dealer and Tech's like Joe Hess! My Suggestion is to keep an eye on Williamsport H-D. With service like that, they will need a Bigger Building Soon. William Nicholas Hagerstown MD. |

Well with my accident a little over 3 weeks ago my 2008 XB12XT took cosmetic damage. Everything came in about 7 days with exception of my cases and one had a 21 day lead on it and the other a 30 day (right took longer than left for some strange reason) all the parts coming from Harley are in already, the ones I'm waiting on (the cases) are coming from Heppco. Gateway Harley/Buell has always been great about running down things for me and making sure that all is right with my bike |

The right side case has to travel further around a track that has more left hand turns than right hand turns. 9 days longer is a lot of laps. |

My local HD dealer and none of the closest ones have or will order Buell parts. But there is one that does 100 miles away. The local BMW dealer is closing and the next dealer is just as far away. |

Buellerxt, Yeah I was very lucky. Gateway even held the XP they have in stock till we knew mine wasn't going to get totaled out. I really do love my bike it's the one I wanted since the first time I saw it so really glad it made it out alive in this debacle too! |

I don't know that there's any law stating that the company has to provide parts and service for seven years. However, if someone purchased a full extended warranty on a 2010, for the maximum time possible, which I believe is seven years, wouldn't HD technically be in breach of contract with said owner if they discontinued a part that was covered? |

As the saying goes "It depends on the dealer" if you can get parts or not. My servicing dealership is Black Hills Harley Davidson/Buell of Rapid City, SD. When there isn't a part in I just simply ask them if they can check other stores if they don't have it. Works great for me. If they don't have it I go to Americansportbike.com or search high and low on the internet. Pretty easy actually. I've never snapped a belt and I have a spare so looks like I'm pretty lucky! Lawsuits are a pain in the ass. You can't expect any good answer to a question about lawsuits. |

Xbeau12s, sounds like you have a good dealer in Black Hills HD/Buell. The folks at my dealership are actually really nice people. They just say they're having trouble getting "some parts". I agree with you about the lawsuit question. Sparked a lot of not-so-friendly comments. Apparently, I fed some of those conversations with my remarks! I'm sorry if I offended anyone. All of the feedback has been helpful in its own way. I have been frustrated trying to get answers and parts. I now have replaced a number of things that have fallen off the bike or failed. I have been more proactive about checking EVERYTHING when I service my Ully. It appears that I have perhaps received some bad information regarding laws about out-of-production motor vehicles. I hate lawsuits and MOST lawyers. (Sorry if there are any of you out there!) Apparently nobody here has heard of any suits. I agree suits are usually unproductive. It really was just a question. Perhaps not so well phrased; but it WAS only a question. Thanks to all of you for your feedback. |
