was driving through a parking lot on the normal lane going in the right direction following the RULES.... all the sudden a car comes out from between some parked cars cutting across all the empty spaces because the dumb b!tch was late to work and was speeding through the lot and trying to get to work.... pulls out right in front of me, we both see eachother at the last second and slam the brakes my front tire hits the side of the car at about 15mph, i go up over the handle bars and head dive right into the side of the steel door... some people in the parking lot call 911 and they all think im dead, im on the ground not moving and the bike is on top of me... after waking up a few minutes later talking to the fireman and the police officer they told me that nobody went to see if i was ok, the fireman woke me up when they got there, and they said i must have been knocked out for a good 7-8 minutes.... why did the dispatcher on the 911 call not tell the person to at least check if i was breathing? if i wasnt breathing id for sure have brain damage if not dead!!! WTF is wrong with people? and its on the really nice side of town... the people also told the cop the lady in the car didnt even call 911, she immediately went back in the car and called her work saying she was gonna be late... anywho, a bad concussion, broken ankle, and some scratches was all i got... had a cheap $90 helmet on, and an riding jacket and jeans... with some skater shoes, hence the broken ankle now im friggin borred, i cant walk around, i hate crutches!!! and there is like 2 more good weeks of riding out here in Cali, AND now i cant fly either soo... my blast is all messed up the adjuster is coming out tomorrow to look at it... the shifter lever bent into a 90* angle and wont go into any gears it just kinda flops around... all the plastics are scratched including the tail, windscreen, tank, the actual tank itself... blinker is broke, headlight bucket scratched, rear blinker scratched, left footpeg frame bent... im worried about the forks being bent. im going to insist they take it to the dealer to get looked at, and not a random shady ass shop... hopefully they wont total it and i'll get a brand new-ish blast out of the deal. hopefully... its an 02 but its got less than 9k mi on it |

Sorry to hear that, Ricky. I'm just glad you're ok, all things considered. I hope your ankle heals quickly. I hope your Blast fairs better than you did. Don't be surprised if they total it and give you a few hundred for it. Blue book on an '02 can't be much. If they will let you, try and buy it back from the insurance company for a few bucks and use it as a project bike. Cobble up a cool bar-hopper bob piece meal from various sources. Best of luck! well i had to work out kind of a drug deal with the insurance guy (not real drugs) to keep it from being totalled... "oh yeah... well, these scratches were here before (on the tail plastic)..." "well that brings it right under the maximum..." so i got the max amount i could get out of the thing if i do the work myself... wrote me a check for $2300 for repairs :P which also included the price of my helmet, jacket and gloves... with the help of ebay, and the classifieds on here i should be able to bring her back to normal for well under $500... the rest is... "mod money" haha (minus the price of new gear) |

You could keep the wrecked one for parts or to build something interesting in the future and the Insurance Check to buy a new/used low mileage one to replace it with. Just a thought. Did you get medical payments also? Here where I live it's better to get the other persons insurance to pay for it if the cops wrote it up as being there fought. I hope everything works out OK. |

Someone should have been checking on you from the moment you hit the ground. I had a guy in an RE class hit hard and knock himself out wearing a fullface. He had a broken collar bone but no concussion, still, he was out for a few minutes. I checked his breathing and kept his airway clear as his tongue slid down his throat. Bastards can't even check on a guy who's down. Ought to be beaten hard. Glad you're good. |

"Did you get medical payments also? Here where I live it's better to get the other persons insurance to pay for it if the cops wrote it up as being there fault" I was wondering about that too. Her Insurance should totally be knockin on your door to make sure you don't sue her for being negligent. Had that happen to me 30 yrs. ago on my MOPED. funny thing was this girls mother called me and said you wrecked my daughters car, and how soon before your insurance pays for it to be fixed? Well back then I didn't have insurance cuz it wasn't needed on Mopeds, but her Insurance company did pay me a visit and pay me off right there to get it fixed. They were worried that I might have been injured and gone after her for medical expenses that's why they actually came to the house. (Message edited by sycho on October 10, 2009) |

I'm glad you're "okay". GET A LAWYER I am simply amazed that they didnt total your bike because $2300 is way more than half its value. But needless to say its about what you would've netted if they totaled it and you bought it back. At least you dont have to get a salvage title. Your forks are bent. Her insurance company should pay for your complete loss. Helmet, shoes, jacket, underwear, lost wages, towing, storage, hospital bills, EVERYthing, etc. A lawyer will see to that. Maybe Fantasyland isnt just at Disneyland and her insurance company (and yours) will be completely upfront and take care of you, leaving you as if the accident never even happened (not completely unheard of). The more likely scenario is that they will string you along until the 2 year statute of limitations runs out and they will pay you NOTHING. Medicals bills and other costs if not paid by then do not have to be paid. The only way they will be paid after the 2 year EXPIRATION date is if you FILE a lawsuit (not just retain an attorney). However ONCE you file a lawsuit they will stop paying for anything until that lawsuit is concluded then everything, including lawyer fees, will be paid out of your settlement. A lot of what you can get (besides if she's rich-but you did say she was on her way to work) will depend on your insurance coverage and hers (IE: did you both have minimum liability?) Its a lot to think about and no its not "The Golden Ticket" either, but you do need to be compensated. Aches and pains can become chronic, lifelong debilitating injuries. Hitting a car can cause 'wiplash', a generic term for all kinds of back and neck muscle injuries caused by your type of accident. If you dont want a lawyer (and it may not be necessary), at least consult one, one that is competent in motorcycle cases. Get as much medical attention now as you need. Injuries not sufficiently treated now will become chronic. That includes physical therapy. commentary to follow and it may be repetitious to some: I still suffer daily from an accident 5 1/2 years ago. An accident I cant even remember, but it was entirely due to the negligence of someone elses poor driving. The medical bills are over $60,000 and still counting, not to mention lost wages. BUY ENOUGH INSURANCE, theirs probably wont be. If you're lucky enough, they may even be a citizen of this country and not some criminal allowed to stay in this country, even after being convicted of breaking countless laws. Cover your own ass. |

PS "and its on the really nice side of town" Doesnt mean much. Deposition quote: Lawyer: "And after the accident what was the plaintiff doing?" Defendant: "Oh, he was just lying on the side of the road whining" Yeah, I was just bleeding out of my skull........ |

yeah they paid for all my gear as well.. the only thing i havent been payed for, property wise is my iphone that pretty much broke in half almost... they are trying to figure out the worth or something. i havent heard anything back about the injuries or lost wages... as a reservist/college student the wages are not a big deal, but what is a big deal is flight time. im missing at least a month of flight time, which they will have to make up for some way. well see how it goes, so far they have been pretty good to me not totaling my bike and giving me the max amount. hopefully the other adjuster is as accommodating |

strange that they didn't total the bike. You might have come out a head if they did. There are enough people hear that want parts to easily part the bike out and get another one. |

There's no way you'd get more than $2300 from insurance for a 2002 totaled or not. I think he did really good there. Its worth more as a running bike. Blasts arent really a good money maker if you part them out (unless you rape people on ebay-some of those prices are ridiculous) and his was all scraped up. He could buy another used Blast in decent condition for $2300 or keep his, put $500 into it and net $1800! |

here is where the money is going... i also have an s1 tuber... 1125cr headlight/fairing for both bikes custom making my own exhaust for the blast (similar to EZ's) new LH switches ebay style rearsets new front tire both bikes are getting integrated tails new blinkers new right fork and lower tree clamp s1 is getting new LH switches 1125cr front end integrated tail and the best part stage 3 XB heads, pistons, and cylinders should have a few hundred left over and then wait for the rest of the money for pain and suffering, lost wages ect. also they gave me $600 for my broken iphone, then i bought a used 3g 8gb off craigslist for 200 :P as for the plastics... the worst one is the fly screen, but that is getting replaced by the front end swap... and the rest i think i can wetsand out with 2000grit and then buff shiny again... well see but im not too worried about the plastics on the blast, its a daily driver |
