Speaking of McDonalds lawsuits you'll be happy to know that a Federal judge dismissed the case against McD's this morning regarding the burgerdoodle chain making kids fat.

As a plaintiff's attorney (and former insurance defense lawyer) I turn away about 80% of the cases that come to me...either for lack of merit or a judgment proof defendant or its something the parties should work out amongst themselves. Its not just the lawyers that have created a quagmire in our courts....our society has gone slap ass lawsuit crazy. C'mon not every fender bender means that Ed McMahon is gonna show up at your doorstep with a Publisher's Clearing House sized check.

Tort reform for the most part is just window dressing....caps on punitive awards rarely come into play because its so damn hard to get a judge to grant a punitive instruction to a jury....and probably rightly so. Caps on med mal suits is just the insurance industry trying to get an unfair break. Perhaps we should go to the "English" system wherein the loser in a suit has to pay the other side's attorneys fees and expenses....

Ah lawsuits, reminds me of a story about the bad old days of Buell Motorcycle Company.

We had no liability insurance, the only company that would even talk about it wanted more money than we would have grossed in 2 years for a 1 year premium.

We figured we were "suit proof". Anybody get hurt on a Buell and want to sue, we'd just hand them the keys to the building and tell them to enjoy trying to make a payroll each week.

For street or racetrack? How much $$$ can you spend? For the track, I think the hot XB9R based racebikes are 130RWHP/385 LBs = 0.34 HP/LB (3.0 LB/HP); that is with a 1350cc racing engine.

For the street the weight will be a bit more but with a 100" engine you can achieve big reliable power. It all comes down to how much cash you are willing to spend on an engine and lightweight go fast carbon fiber and titanium bits.

Guys. Somewhere, I cannot find it now, was instructions on how to cut your stock tube frame muffler, remove the endcaps from the guts, reweld it and have a freer flowing muffler. I am interested in this conversion, but 1) would like to find those instructions again, and 2) wonder whether there is anything particularly tricky abou this and 3) what sort of paint/coating is that on the muffler? Mine has nearly 7K miles and paint is holding up beautifully.

Don't dismiss that thought just yet. And get rid of that pic before WillieG sees it. Shoot, that idea is probably already in clay and SLA. Too late, oh well, watch for it soon coming to a boutique near you. I'll watch for the photo-shoot under the 794 overpass where I saw a softtail (pre-release?) getting photo'd last year. :)

The following might be useful to some of you who have real jobs:

Corporate lesson 1

A man is getting into the shower just as his wife is finishing up her shower when the doorbell rings. After a few seconds of arguing over which one should go and answer the doorbell, the wife gives up, quickly wraps herself up in a towel and runs downstairs.

When she opens the door, there stands Bob, the next door neighbor.

Before she says a word, Bob says, "I'll give you 800 dollars to drop that towel that you have on." After thinking for a moment, the woman drops her towel and stands naked in front of Bob. After a few seconds, Bob hands her 800 dollars and leaves. Confused, but excited about her good fortune, the woman wraps back up in the towel and goes back upstairs.

When she gets back to the bathroom, her husband asks from the shower, "Who was that ?" It was Bob the next door neighbor," she replies. "Great," the husband says, "did he say anything about the 800 dollars he owes me ?"

Moral of the story: If you share critical information pertaining to credit and risk in advance with your stakeholders, you may be in a position to prevent avoidable exposure.

Corporate lesson 2

A minister was driving along and saw a woman on the side of the road. He stopped and offered her a lift which she accepted. She got in and crossed her legs, forcing her gown to open and reveal a lovely leg.

The minister had a look and nearly had an accident. After controlling the car, he stealthily slid his hand up her leg. The woman looked at him and immediately said "Reverend, remember psalm 129 ?" The minister was flustered and apologized profusely. He forced himself to remove his hand. However, he was unable to remove his eyes from her leg.

Further on while changing gears, he let his hand slide up her leg again. The woman once again said, "Reverend remember psalm 129 ?" Once again the minister apologized. "Sorry sister, but the flesh is weak."

Arriving at her stopping point, the woman got out gave him a meaningful glance and went on her way. On his arrival at the church, the minister rushed to retrieve a bible and looked up psalm 129. It said, "Go forth and seek, further up, you will find glory."

Moral of the story: Always be well informed in your job, or you might miss a great opportunity.

Corporate Lesson 3

A sales representative, an administration clerk and their manager are walking to lunch when they find an antique oil lamp. They rub it and a genie comes out in a puff of smoke. The Genie says, "I usually only grant three wishes, so I'll give each of you just one."

"Me first ! Me first !" says the admin clerk. "I want to be in the Bahamas, driving a speedboat, without a care in the world." Poof ! She's gone.

"Me next ! Me next !" says the sales rep. "I want to be in Hawaii, relaxing on the beach with my personal masseuse, an endless supply of pina coladas and the love of my life beside me." Poof ! He's gone.

"OK, you're up," the Genie says to the manager. The manager says, "I want those two back in the office after lunch."

Moral of the story: Always let your boss have the first say.
