There was a report in Motorcycle News this week that Erik was exploring solutions for mounting of the radiators, so I googled for patents and found these:

Buell radiator patent

ROTATABLY-MOUNTED ENGINE

Exhaust system

To be honest, I haven't read them, but if anybody wants to, and then care to comment ...

Sorry, I've just realsied that I messed up the thread heading !

Seems to me like the design patents for the 1125 series.

OK, bad example, although the radiator patent I saw had a date of Jan 2009 - surely Buell would have filed for it before the bike went public ?

Anyway the article mentions that Buell have come up with 3 designs, 2 that fit the radiator under the seat ( 1 of which is behind the engine, the second under the seat mounted horizontally ), and a third which has the radiator mounted under the swingarm.

The filing date should be on the first page of the USPTO Patent .pdf.

I saw it in Australian Motorcycle News too, I should have bought the magazine. They referred to a few patents having been applied for regarding radiator locations. There was a drawing as well, showing what looked similar to an 1125R with the radiator under the seat.

They may have been talking about this:
http://www.faqs.org/patents/app/20080314671

"The radiator 26 is positioned rearward of the engine 20 in front of the rotational axis 56 of the rear wheel 18, and directly below the seat 14."
