People have been putting oil and fuel in frames for a very long time.
I saw that show in the guggenheim way back when and they used the frame for just about anything you can think of at one point or another.

In the late sixties even some NASCAR guys tried it. Got caught. Ruled not safe.

Are there even any Derbi dealers in the US? I could not find a dealer locator on their site...

A neighbor had a Derbi scooter for sale. My wife was interested until she saw how much he wanted. I thought that $2,600 for a $4,000+ machine didn't sound too bad.

Not to disrespect Buell or the patent office, but I believe fuel in frame is not new nor an American invention--Honda Trail bikes have had it since the 1960's.

This one is a CT70 from '71:

Note: the Buell patent specifically defines the break-away steering head for safety without tearing open the fuel tank. NOT claiming fuel in the frame.
