well, it looked like it was gonna be the last nice day until spring. thought winter had all ready set in, so i jumped at the occasion. i set out to get some fuel stabilizer. tucked it in my jacket, and headed back home. thought it'd be nice to hit an on ramp or two. it was, but johnny law was right there as i merged over to the fast lane and hit 90. i eased off the throttle only to find the city sheriff under my tail section. summer's over but johnny law is still out there, guys. i'm gonna bring my bike inside until better weather, and wait for my court date. | ||

he wrote me down for 85 in a 55. still "reckless driving" i don't think it was that reckless, but i'm not the one with all the blue and red flashy lights on my bike, so it doesn't matter what i think. (pout, pout) | ||

Take it to court. Trust me, it isn't reckless. I was doing well over 90 in a 65 while being pursued by 3 squad cars(didn't know that at the time), got written as reckless, showed up to court, brought down to imprudent speeding. No I wasn't trying to outrun the police. | ||

In some states, speeding is considered reckless. Do your homework before you go to court and research the speed and reckless laws for your state. | ||

I don't know how the laws of your state work, but here is what I did with an extremely serious ticket in Wisconsin. (following my lawyers advice) I went to court and entered a not guilty plea. As soon as I had my plea officially entered, I set up a one-on-one meeting with the assistant DA who was handling my case. I dressed nice, went in, shook hands, and told him how much I regretted my actions and how I had learned my lesson. I then asked him if he thought he could downgrade my ticket. The guy was totally cool. He laughed a little and met my low-ball request with a pretty reasonable offer. It saved me a ton of money and 10 days of my freedom. It is well worth the effort. I would spend a few minutes talking to a lawyer to see how the laws in your state work. Having the process explained to me made all the difference. Matt I just went to court for 42 in a 25 in Va Beach. I was clocked at 49. First get yourself a lawyer and a copy of your driving record if you have a as my lawyer put it a "perfect driving record 5 good driving points"(sucks that it maxes out at just five) your lawyer can argue this as an isolated indisgression and work on a reduced ticket and traffic school. I've got traffic school coming up and once passed my ticket will be reduced to improper equipment. You may not be as fortunate but with the reckless charge and possible civil penalties. that money you spend up front may save you a lot in the end. I know it's too late now but in the future you might consider this; "My speedometer has stopped working. I intend to get it fixed ASAP." You will probably still get the ticket but if you can get a receipt showing speedometer repair work done with the correct dates on it to show the judge in court, you can only be guilty of defective equipment (which is not a moving violation.) Another angle that used to work for minor speeding tickets and might still; Pay the fine but pay a few bucks too much. They will send you a check for the overpayment. Burn it. Do not process the check. Until that check returns to them, the file will remain open and not go on your driving record. After about three years, the file will be scrapped. | ||

Depending on the judge you get..can really take care of things without entering a "not guilty" plea. I pleaded guilty and when the judge asked "do you have anything to say for yourself?" Thats when you want to use the correct verbage. Extremely important not to come off bsing lol. Just be straight forward. A lawyer would probably still get you farther... my .02. P.S. A lawyer would probably still get you farther Excellent advice. A lawyer knows the system, knows the options, and knows the game. Unless you get a lot of speeding tickets, you don't have that experience. A lawyer for a speeding ticket costs about $300. It's a good deal. | ||

pandead_dan, very crafty!! i like it the ticket will probably cost around 300, my last one did and it was similar, and not too long ago. i pleaded guilty, and acted all regretful and sad about the whole thing, accepted responsibility for it. got slapped with a 272 American dollar fine. i'd like to not shell out twice that to cover the lawyer, but it sounds like a wise decision, considering the outcome. i don't wanna get locked up in the big house. from what my co-workers have said it is a real possibility especially for a repeat offender such as my self. that's how we roll in p-town, BALLS DEEP! i thought "bad guys" go to jail. guess i better get my sleeves tatted up, and start smoking lucky strikes. get fired from my job of 5 years, divorce my wife, maybe start beatin' on one of my kids to top it all off. or i could just slow down.... yeah right, like that'll ever happen! S1wmike, does you lawyer do lawerly things in portsmouth too? would you recommend him? if so, what was the name? does the lawyer really matter? or is it more how the judge is feeling that day? questions, questions any help is appreciated | ||

In my experience,(I have a lot of experience) it mostly depends on how the judge feels that day. You can do things to sway him such as being polite, dressing up, and kissing a little butt. For me, I've had RACING charges DROPPED (in Connecticut, racing is worse than D.U.I.), and I've paid tons of money for much less. Don't stress about it. They want our money and they will get it one way or another, either by radar ambush or by tax increase. Get out and ride. | ||

They want your money! When it comes time to talk to the prosecuter, just explain that it was more like a very expensive seatbelt violation, or failure to yield, or failure to signal a lane change, or whatever violation you feel appropriate. You may pay more in the beginning, but less in the end with increased insurance rates. If they won't play, then ask for a rescheduling and get a lawyer. | ||

My lawyer was on retention from my retirement, he apparently is the partner in the firm that does the traffic violations. I'm happy with my results but I was somewhat surprised by his performance. I'm sure he would work in p-town cause he is state bar certified, but I think if you talk to some of your friends with experience like this they may have a better law firm to contact. Got popped for not stopping at a stop sign in K.C. Mo. Got an atty and he got it reduced to J walking????? WTF? Whatever, it worked....Kenny BTW the lawyer cost me $250.00, well worth it and I promise, I will never J walk again. | ||
