Madduck Posted on Monday, March 01, 2010 - 07:39 pm: RE: Dogs "Agressive moves on your part can change their attitude and hopefully avoid the accident as they move from "attack" mode to "flight" mode" That is a very interesting idea. If the time ever comes, I hope I can remember this. Sportbikermed Hope your recovery is like my ex, quick and easy. You on the other side of the chart now? How does that feel? dannybuell (Message edited by dannybuell on March 01, 2010) |

The hard part is remembering what to do. Last time I had a dog encounter it happened so fast I couldn't even think back to the MSF class when they say vary your speed to confuse the dog. |

Hint . . . based on experience. I do not . . . . by the way . . necessarily disagree with you. But . . . use caution in posting things like this on the internet.
quote:I talked my lawyer buddy today. He said if the dog wasnt chained up and ran in front of you that is the owners fault. No dog should run free of there property. It was the dogs owners recklessness that caused the wreck.I would sue.I dont care if I get bashed for saying it.If I got up and that dog caused me to wreck. The owner would be crying as I chocked there dog to death. After that I would work on them for a little. This story really ticks me off.Just complete wrecklessness of the owner.
They have a terrible way . . . just as you are about to win a case . . . of coming back to haunt you. Paul . . . you convinced me. If I saw you aggressively riding at me . . hell, I'd rethink my entire life knowing you. . . . Not sure I'll be able to sleep tonight. |

Well I talked to 2 different lawyers today and both said they didn't feel like I have a case. WTF? |

For what reason? The only thing I can come up with is They would say you Failed to control? It would turn into a finger pointing match and I believe you would win but it would take years. I'm not a lawyer and don't take my advice . It all depends on how far you take it. Ask your insurance company. They have lawyers on hand just for this stuff. |

I will do that when I talk to my adjuster tomorrow. I wasn't even gonna ask for him to pay for my bike. That's what I have insurance for. I just want him to cover all my medical bills that are left over after my insurance pays out. I will be paying on them for years if not. |

Talk to your insurance company, they will probably be interested in getting their money back from the dog owner. |

you need a lawyer dude I was in a serious accident and helicopter bills dont mess around get a lawyer best thing I ever did you need to sit down a right out the whole event before you forget, every detail. You have a case you dont have to rape the owner for everything he has but you need a lawyer they work on a percentage of your settlement so no money out of your pocket. some attorneys have an agreement where they only take there cut if your settlement covers all your bills and damages. The statement "in God we trust" and all else cash!! you are asking this guy to pay your med bill GET A LAWYER!!! |

Surprised me to hear the two lawyers you approached thought there was no case. Maybe you just need to find better lawyers to ask. I have to ride by at least 2 dogs every time I leave my property. Sometimes as many as 5. Some of the dogs are unruly (I blame the owner) and create a riding hazard for me. Even though these are neighbors I would never dump my bike to save one of their dogs an injury. I am a human. They are dogs. Who is running this place? Humans. I love dogs, I've had dogs. I will probably have more dogs. But I also trained them to keep them out of trouble. People that let their dogs wreak havoc need to be responsible for the financial damages. |

I would kill the lawyer talk now and let him handle it. This thread could bite him in the azz in court. Good luck and feel better. Hopefully your healed for riding season. |
