I bought a used ATV from a guy in Ohio. His line was he just paid it off and the title was in the mail to him. I gave him a few weeks. And he is ignoring emails and phone calls. Yet is still active on ebay. The finance company will not even tell me if the ATV was paid off or even finance by them. Zero help. All I've got is a bill of sale. | ||

I hope you also have the ATV at least. You can run the ATV basically for ever without a title unless you run into licensed riding areas, pulled over by the police, or go to sell it. That finance company can only answer questions about his dealings if you get a warrant or subpoena to legally force them to do so. You would not want any of the banks that work for you violating confidentiality laws. I would get a hold of the fine folks at E-bay and at least mess up his sell record. You have got legal grounds to recover that title if you have done everything correctly and legally on your end. It just takes time and money, or maybe a properly placed threat of legal action if you can reach the person. I would try that through registered return mail first. | ||

Document everything while it is still all fresh, then a 15 minute consult with an attorney to line up your ducks, then a certified letter, then small claims court. Otherwise just ask for a full refund since the seller didn't comply with the full agreed to deal by including title. But first verify with the state of the approximate wait times for paperwork. I know a local person who had to wait for four months to receive plates and registration for an out of state vehicle purchase. side note: there are many many bikes/cars/trucks on the local Craigslist that are being sold and advertised where the ad states that there is no title, and there are regular posters who upload "ads" telling people to be carefull of non-titled vehicle sales. Some sales are legitimate, some are not, some get sorted out easily, some never do. At the very least I try to get a copy of the current registration from the seller showing the seller as the current owner. Would suck to have to pay more to clear the title than was paid for the vehicle. (Message edited by mikej on June 01, 2007) | ||

As a past and present owner of many many atv's and dirtbikes I would just add that I have purchased the majority of them without a title. In MA you do not need a title to register an offroad vehicle. I do however go to the police station and have them run the VIN to make sure it isn't stolen. To each's own but a title for an offroad vehicle isn't that important. I have NEVER been asked for a title from a police officer when getting questioned for riding in an area that I'm not suppose to be in and NEVER been hassled when selling one of my bikes without a title. Bill of sale is good enough. | ||

Titles are not an option in Wisconsin. You could not get one if you tried. Good luck. | ||

Thanks guys for the info. I don't need a title in my state either. And I plan on just riding the atv. However - I wouldn't have purchased the ATV knowing the title was in limbo. I do have a good bill of sale. And have filled a paypal dispute for the small deposit. | ||

Ryker, Even with that, I would at least mess with his reputation on his ebay account. If he promised you a title and didn't deliver others who may purchase from him should be aware. | ||

Iowa has been trying to title ATVs. A couple of years ago I had bought my daughter a Suzuki DR200 that was street legal. When I went in to get an ATV permit for it they made me pay to have a 2nd title for it that was an ATV title. I argued with them (but who ever wins an argument with the government). I kind of wish I still had that bike since it got 90mpg. | ||

They all come with a 'Certificate of Origin'. Some turn that into their state for a title, many states don't offer to title an ATV (MD doesn't). I prefer to get or pass on the COO, but it isn't needed in PA or MD to register a bike/ATV to ride on open public properties. | ||

If he's close to me and you cannot contact him I could go to where he lives and see what the holdup is. Maybe there's a rational explanation? |
