Is the race muffler from Buell for a xb9r the same as a xb12r? I was thinking about getting one on ebay but the seller did not know.

Yes.
The only difference you need to be worried about is what year the pipe is.
The 03s will hit (not much, easy to fix) the idle pulley on a newer bike.
