I've periodically searched for EBR patents over the last few years, and it it occurred to me that ownership of these patents may be of particular importance considering the current situation, especially with regard to Hero. I'd be interested in knowing the logic upon which you base your "good" and "bad" metrics. Be mindful that roughly 50% of those named separated from EBR 1 - 3 months prior to "Black Wednesday". Control off IP is a legal concept .... While it may be a running play or a passing play .... It's not a touchdown. Think big. | ||

Court- I was just basing that on the "assignee" of the patents. The hybrid motorcycle patent makes no mention of EBR or Hero for that matter, so that would seem to mean Erik and the others listed could build or license hybrid motorcycles built under this patent regardless of what happens with EBR. The last 3 patent applications above list EBR as the "assignee". If the patent applications are approved, wouldn't that mean that whoever acquires EBR out of receivership would also take ownership of the patents? That certainly isn't necessarily a "bad" thing, I'd just hate to see Hero get them. | ||

Patent assignments are contracts Anything, absently patently illegal acts, is fair game. The assignment could be rendered "null and void upon the occurrence of 3 successive cloudy days". That would be legal and binding. Patents are oft times hidden in obscure names ... Perhaps the inventor's 3rd cousin, so it's incumbent to know and read the whole of the contract and any codicils. I've learned some of these things by basing strategies on what seemed normal, logical and intuitive ..... When real life was actually a twisty road. If you're feeling like a glutton for punishment spend some time to study jurisdiction and venue ....oh, and Indian commercial law. What will the contract be interpreted under and where. Very easy to include "any action shall take place in Dehli Commerial House and interpreted under Indian Transactional Court Rules" Involved in one now. You're logic is a good start just be aware that, absent data, inferences are necessarily best guesses. | ||

OK- thanks for the educational info. I guess that could imply there are other (maybe many other) EBR-related patents that would not be easily found. Cool. | ||

Also just holding a patent does not mean you have the expertise needed to actually build something. Patents are not instructions; they try to present enough info that someone can't make the same thing without infringement BUT also present little enough that it will be hard to build the item after the patent runs out without major engineering work. A company I worked for built a double recrepe paper machine only because we were able to hire all the engineers that developed it for Scott paper. the patents were expired but without the knowledge these guys had the machine would never have produced quality paper. |
