So how does this work? My uncle just bought a 1190SX a few weeks ago. How will he go about getting parts? Warranty is gone im sure, I doubt dealers will support the bikes. Fairing brackets, radiators, fairings, levers, brake rotors, sensors, etc .... |

Nobody knows yet. Parts Unlimited handled the distribution of EBR parts, and has some amount of spares in circulation which may be available to dealerships. You can't walk into a Parts Unlimited dealer and get EBR parts, at least not yet. Don't give up on the warranty yet. I imagine there are many possibilities as far as the results of "receivership". If EBR is sold as an intact motorcycle company (EBR's lawyer says that is the goal), the new owner may honor the warranties for existing bikes. Even if EBR is broken up and sold as a bunch of stuff, the receivership settlement may require that some of the cash from that sale be used to support existing dealers and warranty work. It ain't over yet. |

To be clear my understanding is that 128 unlike chapter 11 has no provision for the write off of any of the debts, it freezes interest from compounding until the debt is paid and prevents creditors from seeking actions to collect the debt while it is restructured and paid out over a max of 36 months. So dealers with warranty claims SHOULD get paid, the question is when and how much, and would even be worth the wait. (Message edited by Classax on April 21, 2015) |
