Keith, Knowing what you are after here, I suggest that you'd be far better served asking for an attorney familiar with "product liability." Your post above makes it sound like you want to sue someone. |

Reading between the lines, that sucks. I have absolutely no knowledge of the situation, but as a PURELY UNRELATED story, if I were to have a low side on my XB, and one of the Buell frame pucks failed, and the tank was damaged, I would not be blaming Buell. I looked at them, I evaluated them, I bought them, I installed them, and I take my chances. I hope I never need them. If I do need them, I hope they work. If they don't, well, I suppose thats why they call them "accidents". |

I don't think that Keith is in trouble, yet. I think that he's just being proactive in trying to prevent losing his house to some frivolous lawsuit or even trying to learn if that would even be possible in his case. |

File as a LLC (Limited Liability Company)if your state allows them. In Kansas it's a simple form from the internet and a $165 fee to the state. It will go a long way in protecting your personal assets. |

I know I will take some poop for this one. If your looking for products liability advice consult a well versed commercial insurance broker that lives in your area. They can answer most questions with respect to products liability and also recommend policies to protect against lawsuits. Keep in mind that sometimes performance related issues may not be covered by policies and you would require other kinds of protection. As for lawsuits - the laws vastly differ from State to State, say in Texas if a frame slider failed while attempting to use it the rider may be able to shoot the manufacturer - Sorry Blake I just couldn't resist that one!!!!!! All joking aside - go see an experienced broker/Risk Manager that deals with liability insurance. If that don't satisfy your questions then consult the lawyer. |
