In 2001, Sonia Sotomayor, an appeals court judge, gave a speech declaring that the ethnicity and sex of a judge “may and will make a difference in our judging.”

This month, for example, a video surfaced of Judge Sotomayor asserting in 2005 that a “court of appeals is where policy is made.” She then immediately adds: “And I know — I know this is on tape, and I should never say that because we don’t make law. I know. O.K. I know. I’m not promoting it. I’m not advocating it. I’m — you know.”

"I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life"

I always knew my life was more boring than anyone elses.

I really don't mean in a bigoted sense in any way as I have nothing against anyone based on race, religion, sex, sexual orientation, etc, but it's hard to look around even my own workplace and take notice of the kind of folks who are in the positions they're in. Not bad people, just way underqualified (and one I personally know who doesn't even WANT the position they have).

I don't know anything about this Justice that has been recceomended by the President, but I hope to god that her race and sex plays NO role in the final decision, just I hope that a white male's race and sex would play no role in the decision as well.

I know for a fact that the Diversity Campaign that Coca-Cola is on has really hurt their production (corporate level, bottling and distribution is a whole different entity) for just the reason you stated, and one of the reasons I'm no longer under contract with them.
A white middle aged man is still doing the job this white middle aged man was doing.
The difference?
I owned my business, his wife "owns" his, which makes his business a minority owned business.
Which puts people like us in a spot. We have to live with it, suffer from it, but, if we're against it, it sounds as though we're a bigot, or bitter...

Which is why I struggled for a bit of if I should have made that post or not, because some people, I'm sure, will make it into something it's not or put words in my mouth.

By no means do I think that minorities have it easy - I have no illusions of the "old boy's club"... but it comes as extremely flattering to me when others recognize me for what I've accomplished or stand for. I'd hope that goes for everyone from everyone.

Glitch - your story isn't all that uncommon.

Her race and sex played the ONLY role in the final selection by Barry.

That and her viewpoint that her role as a judge is to make policy.

I'm afraid we are going to long for the days of Justice Souter.

I have no illusions of the "old boy's club"...

That club swings in all kinds of directions. It's not always about your race. Where you went to college or if you went to college at all, your social status, physical stature, do you play golf, are you a Mason...... are a few things that come to mind.

Fair?

Life is not fair.

Muscle up or wise up - the strong (physically or mentally) will always win.

You just have to know which of the two meets the criteria for the arena you want to win in.

My 2 cents.

OH MY GOD A LIBERAL DEMOCRATIC JUDGE APPOINTED BY A LIBERAL DEMOCRATIC PRESIDENT!! I AM SHOCKED! SHOCKED I TELL YOU! HOW COULD HE DO THIS!

Come on guys she is just what is expected and from this liberal Democrat's point a view she will be a good addtion to the bench.

You guys lost, it is not the end of the world, every 4 years for two centuries someone has lost and the Republic endures.

Dave by the time this administration is done we will have ALL lost. Pandering to the handout crowd with health insurance and bailouts while sucking the last breath of productivity from the American worker. The government does not produce and is taking from those who do to give to those who don't. And now adding judges who relish in legislating from the bench? We all lose.

Interesting times indeed.

I laughed yesterday day when the commentator said . . .

quote:

"Our first minority President (not sure that's true, but for the sake of discussion) appoints a female minority Supreme Court Justice . . .now there's one I didn't see coming".

That even made me laugh.

I was, in a strange way, relieved to see Obama being interviewed the other day and confirming what I thought . . . "that's it, we're out of money".

Thank goodness. At least now we know where we are and can get our bearings as we slowly begin to repay the Chinese the largest debt in the history of civilization.

I keep asking myself if I'd gone on the television, in front of the world, and proclaimed myself . . . . for NO reason other than being a "white male" more capable of making better decisions than a Hispanic Woman . . . how long before I'd be forced, by public outrage and condemnation, to withdraw. I estimate roughly 5 minutes.

We've lowered out standards and accept "coming from a humble background" as a job qualification. I'm not diminishing the experience but I've never listed "born and raised in a 29' travel trailer towed behind a 1939 Chevy from one construction job to another" on my resume. Nor have I mentioned my Mother having to do diapers in the chamois wringer of the Phillips 66 station in St. John, KS when she didn't have a washer. It makes cute story, it's not a job qualification.

And what are "real life experiences"? Can one of you share a "false life experience"? Guess what . . . . we ALL have them, each and every one of us. The build character, those times we didn't get picked for the football team, couldn't make a car payment or got our ass kicked. The wealthy have them, perhaps in more comfort, just like the impoverished.

Would you buy a motorcycle from a dealer just because he had a "humble and challenging" childhood?

No kidding . . . Americans seem to be soaking this stuff up like dixie cups of free tuna salad in the aisles of Costco.

Former Republican Speaker of the House Newt Gingrich may be on to something . . .

quote:

. . . . called Sotomayor a racist and Twittered this to followers: "White man racist nominee would be forced to withdraw. Latina woman racist should also withdraw." He also said "new racism is no better than old racism."

Im sure we'll be hearing more . . . . interesting that even Democratic attorneys and colleagues view her and less than average as an attorney and more likely to use screaming at someone than wisdom to convey her opinion.

quote:

The most consistent concern was that Sotomayor, although an able lawyer, was "not that smart and kind of a bully on the bench," as one former Second Circuit clerk for another judge put it. "She has an inflated opinion of herself, and is domineering during oral arguments, but her questions aren't penetrating and don't get to the heart of the issue." (During one argument, an elderly judicial colleague is said to have leaned over and said, "Will you please stop talking and let them talk?") Second Circuit judge Jose Cabranes, who would later become her colleague, put this point more charitably in a 1995 interview with The New York Times: "She is not intimidated or overwhelmed by the eminence or power or prestige of any party, or indeed of the media."

I think she'll be appointed but I remain disappointed with our lowered standards. If this were a car . . . you wouldn't buy it.

Keep an eye on Rahm.

“court of appeals is where policy is made.”

I don't like it, and it shouldn't be this way..... but it seems like she does at least understand the current state of the Federal Court System.

Unfortunately, due to dysfunctional legislative and executive branches the appellate courts have been able to take on a larger and larger role in the setting of policy for this nation.

If the courts are going to be "activist" they should be looking more at the separation between federal and state authority and striking down laws where the federal gov't has exceeded its powers as laid out in the constitution.
.... but I know, its just a pipe dream of mine.

>>>>perfect example

Need another?

My wife, who when she was working, made something like 27X what I have earned in my BEST year . . . is a female Italian and eligible for federal funding (with nearly no strings of qualifications) to start a business. . .

She also, simply cause she's currently working as "my gardner" and spent last summer visiting the beach . . . is technically "unemployed" and eligible for all sorts of federal "help".

There are things ya gotta love about this "we'll take care of everybody" logic. . . . but there is a part of me, just like making a purchase, that is always hankering to ask . . . "well, okay but HOW MUCH?".

They could care less how much . . . they need more, they just redistribute it.

Exactly - would you care how much it cost if you didn't pay your taxes, either?

What . . . feel free ti guesstimate . . . is the probability that you could select 15 folks from a sample in the United States and find EACH of them in some sort of "unpaid back taxes" litigation/action with the IRS?

How many folks, here on Badweb, I wonder currently are fighting with the IRS over unpaid taxes.

You are getting screwed on the leadership you are paying (and paying BIG) for.
