Do the RIGHT thing. Follow through with the claim. Inform the police of the situation in full. |

Well I got mixed responses. The accident investigation dept. told me they can turn her in for leaving the scene. He said she was probably drunk, and that's why she left. So I called back and talked to a Det. about the extortion end of it. He said as long as we contacted the owner within 24 hrs. and took care of the damages, there's nothing they can do. But the prosecutor will not pursue an extortion case like this. Like it's small potatoes! WTF?! So the police will come after you for leaving the scene (in a parking lot!) for a cracked bumper cover, but not for extortion!!!! |

First off, I want to say that I do respect Police and appreciate the work that they do. Without them we would be fuct. That said, I want to adress Dako's last post; The response you got is exactly why I nearly never call the police. I take care of it myself. I'm not saying I would go out and beat the guy down (I might) but that I would carefully weigh my options. One of which is to do nothing. My primarary objective is to not make the situation any worse. Secondary is payback and compensation and my rates are high. A recent example- My neighbor told me he ran off some scum going through mailboxes on this street. I did call the police but not to report the crime. I called to tell them that this occured and that I intended to defend my property. Patrols were noticably increased and it has not happened since. |

Similar incident here... My mom called me freaking out around Christmas because she came home, the garage door (attached garage) was open, she went inside, there was a burner on the stove on and the other was clicking(gas on, not lit!). She turned the stove off and went outside and called me. I came over and we called the fire department who checked the natural gas concentrations. They suggested that we call the police even though nothing was missing or disturbed. The police wouldn't even come out, they actually told us that she probably left the door open and the burners lit... |

"But the prosecutor will not pursue an extortion case like this" That happens a LOT more than you think... The Police have no control over what the SAO or DA decides to prosecute. |

Talk to her Ins. Agent He/She will know the Laws better and you are already paying for it. You will always get mixed reviews from John Law unless they are a really good friend. Find out if there truly was a video in the area. More than likely there wasn't any. I had the same thing happen to me in Ks.. All I can say is my Insurance Agent saved me allot of money & time. |

Paint said it exactly right. We as LEO's have no control over what the DA or Pros office does. Its not only frustrating for the people we help but its just as bad for us. Prime example is I just caught a guy with a gun, (no permit) the pros office did not pursue it. Said he put on his friends pants and did not know it was in the pocket. A week later he shot and killed another kid. So we feel the frustration too. Hope things work out foryou and I am sorry they did not help you more. |

I'm not angry with the police. I know the system is the problem, but there's no easy fix. We're meeting with the owner of the damaged car today to get a copy of an estimate. That plus a copy of our cell phone records showing we initiated contact within 24hrs should cover the necessary backside! When they ask about $ for the tape, I'll simply tell them they have to play a little game I like to call "Hide and go F*%k yourself"!!!! Thanks Again for all the help. |

A video of the interaction or at least a cassette or mp3 recording of the contact would be worth while to have for your own defense. Avoid making any threats or any threatening language/actions. Document EVERYTHING! |
