Firstly, I am not sure if this is exactly the right place for this but I was going to be long and wanted my own thead so I didn't impose. Secondly, I have only been a buell owner since the beginning of the summer and I use this forum everyday.

Now for my predicament. I have to start by saying that I am only 25 with no local family or contacts. I am in the military and just moved here. My local dealer is Greensboro, NC. I started riding this summer with a Blast I picked up from a car dealer. I had never ridden before and it was great. No problem with the bike or new riding. Needless to say it got me excited and I was soon ready to move up. I was in the dealership mid June for exhaust gaskets and saw an 04 12s. I thought it was a good price and was very interested. I talked to a salesman and he said they would take the blast for what I owed. Good deal for me right? I applied for the loan with my out-of-state credit union(military) and was approved for a trade. I was to have a check inhand for the difference in the bikes and was going leave the check and the Blast and take the lightning. Things were messed up right from the start with my credit union not setting up the trade funds properly and it took almost two weeks to get what I needed for the buy. When I went to trade I found out that the credit union had never recieved my title on the blast from NC. I soon found out NC had the wrong address. NC said they could reissue a title but I had to wait 5 weeks. Needless to say I now know it should be 15 days not 5 weeks. I told the dealership and they said we could go ahead with the sale and they would sell the blast when the title finally got though. My credit union stated that they would not send the title to the delership but only to me. We all agreed this would work. I then came in with my check and the blast. I signed everything and was issued a 30 day temp tag and was told I could not transfer my plate but that my new one would come in shortly. This was on June 22nd. I left with paperwork and the 12s. I came in once to sign my new title over to my credit union. Other than that I had no other contact. I was recently called to find out if I had received the blast title. I told then no but that I would check on it. I have been periodically calling to check if my tags had come in because my temp was expired by a month now. No plate. I called to check on their title. On Aug 6 NC mailed it out and my credit union never received it. So I am in the exact same boat. I call DMV and find out that my new bike was never registed in my name and I am still register as having the blast although I have been riding the xb for 2 months now. We I finally confronted the dealership, they say that it was a clerical error and that meant to transfer my tags but there was a mix up. I am now being told that they will do the DMV paperwork but will not give me my plates or registration until I give them the title for the blast which I don't have. From what little I know of the the law, they cannot hold my DMV itmes and they were supposed to file within ten days of the sale. I have researched and found out that I can get a release form for my title and go pick it up in person. The dealership keeps telling me that until I give them the title they always keep DMV paperwork. I cannot believe this is legal or connected in any way. I cannot ride my bike without plate or registration. I have actually been illegal for two months now. I have done everything I can to get them their title but I fail to see how that is my responsibility. They have a power of attorney for me and a bill of sale. They should be dealing with the DMV and the credit union. It's now their bike and I have sold it. I have done everything on time and correctly and they are extorting me with my DMV items. What can I do? Have I just wasted everyones time by writing this? I just see that you guys have helped other people in the past and I don't know what else I can do. Sorry for the long story but I didn't want to leave anything out that may be relevent. Maybe this wouldn't happen if I was a fifty year old man with a money wad and buying a new roadking. I feel like they are taking advantage of my ignorance of the system. Any advice would be appreciated. Thanks -Jay

Sorry for your troubles; I'm sure it's rough to be a long ways from home and in this predicament.

Sounds like the main problem is with (predictably) the DMV. I can understand you being ticked off with the dealership but basically they have a Blast which legally still belongs to you which they are unable to sell. Until the title for your Blast is legally transferred to them, they could be left holding the bag. If they don't get the title, they are screwed out of two or three thousand bucks.

Sounds like the best thing for you to do is get the Blast title in your hands and to the dealer as quickly as possible. Maybe your dealership can offer some assistance in dealing with the DMV on your behalf to get your title. Dealers seem to get better treatment and "know the ropes" better on dealing with the DMV.

DMV's can be a royal pain to deal with but sometimes dealing face-to-face gets things done a lot faster. Some of the BadWebbers from NC may be able to give you more specific advice on dealing with the DMV.

Thanks, Whodom. But thats not true. The NC title manual says that if the dealer has the bike and a bill of sale then they don't need anyhting else. They can fill out 1 form and then get a title issued. Also they have my power of attorney for limited signature. Not to sound indignant, but I am not required by law to hand deliver them my old title. It is their responsibility to get it from parties involved. Thanks for the input. I may have to eat some "humble pie" and just do what they say, but last I checked America is where we fight for our rights and dont't just get in line cuz big brothter says.

Don't think the dealer is screwing ya.

Easiest way out of this is to have the title to the Blast and drop it off. Have NC courier or overnight it to you at a location where you know your definately going to be.

Seems like thats the sore point.

You can't compare this to a 50yr old buying a Harley!!!!Each situation has its own merits and circumstances.

Thanks Newfie. I am trying not to come across like a spoiled brat but I have done everything on the up and up and I wasn't even told that I have been illegally riding for two months. Now I can't ride and I haven't done anything wrong at all. But, thanks for your input. All I want is to do is ride. Is that so wrong?

Man, hang in there. I'd suggest going to the dealer and talking to them (sales manager or someone higher up) and explaining your situation. Maybe at the least they will give you another 30 day temp tag while this gets straightened out. You may be dealing with a grunt in their front office who just knows "it's our policy" to not give you your paperwork, nevermind the circumstances. Hope you get it worked out.

Swang- You can also seek advice from your Base (Post) legal office. I'm sure they have walk-in times. It sounds like they beef is with the DMV and not you. ...and start all conversations with "I need your help" Visit the DMV in person.

I agree with you. I wish I was on a base but I am on I&I duty 4 hours from the nearest base.

I consider it is an honor to serve. I count myself lucky to be allowed a chance. It's because of 20 yr vets like you I have that opportunity.
