I'll have some pictures to share soon, had a head on crash in my car last night. Car is totaled, mildly hurt, angry, going to be poorer no matter how you look at it.

Congrats on not being in a hospital. Same thing happened to my mother Last week. I'm taking my turn at the overnight in the ICU with her.

Super compound broken left ankle. 2nd surgery yesterday, third coming up Fri or Mon. Fourth next week on right ankle. Five broken ribs just for respiratory fun.

Worst thing is an orbital fracture letting air from sinus cavity into eye area causing swelling. Minor enough that it is non-surgical, but massive pain in the @ss. Need to hire a lawyer, the other insurance company is already pushing me for things. I was rather hostile and told them not to call me until I can talk to my insurance and probably a lawyer.

So what kind of car was it? Just curious to see how you to think it performed in the crash.
Couple of years ago my son-in-law was driving me in my wife's car, a 2014 MB E350, to the meat market. Suddenly decided he was heading the wrong way and flipped a U-turn right in front of an 18 wheeler which t-boned us at about 50 mph. Totaled the car yet I was able to open all 4 doors and the trunk to retrieve our gear. Nobody hurt. New cars are amazing.

2015 Ford Fiesta. It did it's job, but what I discovered is that the frame that the bumper bolts to was extremely rusted under the paint. Left a warning for others on the Fiesta Forum to check their cars.

Pretty incredible that you were t-boned at 50 MPH by a big rig and were able to open all the doors. Was that Mercedes made of some sort of space age material?

Not looking good, I'm not injured badly enough by the sounds of it. Going to be out about $10k by the time I replace my paid off car with something available today with similar features. Will lose at least 4K if you consider $2k per year depreciation which is way more than I should have to tolerate.

Monday I have an appointment with a surgeon to discuss my fracture, after that the law firm will decide if it is worth the money for a personal injury claim. Going to bet I get the short straw here and another drunk gets away fairly free of penalty.

I also have a tremor in my left hand that doesn't seem to want to go away. Need to get a referral to a specialist about this. Not sure they will believe this is new though, and not sure if it is "damaged enough" to cause them to pick up the case.

Value on my car is much less than I assumed. Got a letter from his insurance saying they have decided that their client is 75% at fault and I will receive 75% payout which will be practically nothing. Our country and many of it's laws make me sick!

Take the letter to your insurance company and ask them about it?

In an accident I had a long time ago, my insurance company handled everything (made me whole) then billed the other persons insurance.

Since you still have it, look very closely at the main frame section from bumper to firewall! It's a box frame running the length of the engine bay front to firewall on both sides. Mine was significantly rusted under the paint, large portions of paint flaked off when it bent to reveal the rust. With 3 years and 2 months from a car built in the summer of 15, that level of rust makes me not want to buy a used Fiesta.

And with 74000 miles on mine, the value is insultingly low. to the point where it is almost not worth cashing any payment they send. Going to take a $15,000 to $18,000 hit on emergency reserves. Stuff held back for things like new furnace, water heater, roof, etc. Puts us in a bad situation overall. Don't want to finance a vehicle, puts us into a different bad situation if one loses a job.

Finally got the police version of the accident report, pretty much matches my report. A friend pulled a string and got it for me. Also got that the guy was arrested for DWI pending investigation and court date to confirm final charge. That part won't be official until court has happened. Need to talk to the DA.

A conviction would put him at 100% liable as far as I know. Have you talked to your insurance people about what they can do for you? I know you probably already know to keep detailed notes every time there is anything communicated. I kept a notebook just for my accident. Don't be afraid to take time off work for any and all pain associated with the accident. (That goes in the notebook) Any quality of life lost goes in the book. I had records of overtime worked prior to my accident and lack of overtime put in after documented. My chiropractor submitted a year of bills and got paid.

I have heard of insurance companies trying to get people to accept that their client was only xx% liable. It's a common ploy. If he got a DWI, and crossed the center line, I'm sure they will fold on that like a house of cards.

I had a good friend many years ago that had their Ford Taurus totaled by another driver. The insurance offered what they claimed was the value of the car. They went car shopping, looking for a comparable car. They couldn't touch one for what was offered. They contacted the insurance company, with specific examples of cars they looked at. In the end, they got a replacement, 1 year newer, less miles, and slightly better options. This might be difficult if you aren't looking for a direct replacement though.

I guess my point though, is that you have been forced into a negotiation with a party not of your choosing. They will look after their interests. Make sure you do your best to look after your interests. Your insurance company should be willing to do this for you should you ask them. Keep it professional, and don't let them get under your skin. If medical issues get complicated, a lawyer may become necessary. Lawyer fees suck though. They do deserve to be paid, but that comes out of what you get.

Before all else, make sure you get yourself healthy again.

They tried to prorate one of my tires in the wreck that had to be replaced. I went off. 1. I did not choose for your client to destroy my tire. 2. I keep a matching set of tires on my vehicles. 3. At the very least I would not install a tire of a different size on the front axle of a front wheel drive vehicle. After a month of repairs my car still had over 30 things wrong with it. I went to the lot where my car was the night prior to picking it up and took my time going over it. They were incredulous that I ventured onto their property the night before. I was incredulous at the theft they were trying to perpetrate on me and was glad I took the time to investigate the service not rendered. At that point I called my insurance company in front of them and went down the list of over 30 items with them that were still wrong. I found out the adjuster that looked at my car didn't add the airbags into the claim. The total with airbags should have had the car totaled and the car was only a few months old.
