My wife informed me that I received this letter from the EBR receiver, she only sent me a pic of the first page but said there are multiple pages. Im on deployment and have no way to look at the rest of the pages until my wife gets around to emailing them to me. Have any other EBR owners beside myself received a similar letter?

Interesting. Sounds like this is the first divvying up of the money collected from the sale of EBR. The receiver gets his cut for his effort in handling the sale. Silverman handled marketing EBR to potential buyers. I don't know about the others. |

Just the troops asking for a chunk of what's due them .... There'll be several iterations. Nothing gets dispersed w/o being ordered by the Court. |

This is good news. It gets the ball rolling on getting the only American made production superbike, and "new" EBR company, back in production and marketing modes. |

It seems like this action should be completely independent of anything to do with the "new" EBR motorcycle company. The motorcycle business and associated assets have already been sold and approved by the court. This letter has to do with compensating the people who handled the receivership using a portion of the proceeds from that sale. If I'm wrong, and all the groups who were interested parties in EBR (employees, suppliers, etc.) have to be paid from the proceeds of the sale before "new" EBR is free to resume operations, it seems like it'll be at least another month or two before things can get rolling at "new" EBR. |

That has nothing to do with the sale or the new company, whatever they elect to name it. It's simply to process of allocating proceeds getting underway. There are prescribed and tightly defined formulas. The instant group, those retained by the receiver, enjoy a certain preference for the obvious reason that, did they not, no one would touch the work. Regardless, obligations ( in this case undistributed PTO amounts) still sits atop the hierarchy...followed by trust fund accounts (SUTA, FUTA, withholding taxes) ...then the attorneys and consultants. The folks associated with the successor entity are uninvolved in,, and hopefully not distracted, by these procedural matters. That's good ..... They've a task before them akin to climbing a greased mirror. I hope they're getting good advise. Court |

To those of you that received this letter, what was your part in EBR, employees, subcontractor, investor? |

My part in EBR. I'm an 1190 owner with no warranty cracked body work and corroded starter. The bike came with a warranty when I bought it, it had 5miles ( up to 750 now). The dealer I bought it from was more than willing to do the warranty work but with no EBR the repairs never happened. I just want EBR back along with my warranty thats it. |

I wouldn't expect ANY problems at 750 miles |

I assume I'm on the list b/c I bought an RS and registered it a month before the shutdown in April. No problems, almost to 1,000 miles. |

I got the same paperwork. I did submit a claim to the court for loss of warranty and diminished value due to the shutdown. I am sure I am way down at the bottom of of the list for getting any $$. |

Got another letter today. This one in relation to wages for employees (I'm just an owner). Unfortunately I fear Dean's comment will end up being true... 1313 |

I got the wages one today ... I thought it might have been something different since it came in a letter size envelope instead of the typical large one. |

what are you folks expecting to get? Hybrid, I think most of the EBR owners (especially the ones who've had significant issues since the closure) are hoping their warranties would be picked up by the new company. This bit of hopeful news was posted to EBR Europe's Facebook page this morning:
quote:In addition to the activities for the restart of the EBR factory in Wisconsin USA, CEO Bruce Belfer has officially confirmed that EBR will continue to market the distinctive high quality brand in Europe. EBR HQ Europe is located in Alkmaar, the Netherlands. We are all working hard to set the wheels in motion to get EBR upright and roaring again! Thanks for all our supporters for your trust and commitment.
