This raises the question of whether Obama really wants states to agree to his fix. More likely, he views the situation the way California, New York, etc. do, and has offered his fix as a stunt to reduce the political damage resulting from his false promise that people who like their plan can keep their plan.
I'll note in passing that the head of X insurance company would have to be insane to commit the criminal act of selling insurance that is illegal under the law on the promise of protection by the President.
I would demand a pardon, in advance, for all crimes, and a contract that I would be protected from the certain lawsuits my firm would be subject to for selling illegal policies that do not cover the legal mandated conditions.
If Obamacare mandates free birth control pills, or acupuncture, or lollipops, and someone does not get it, they have every legal right to sue.

The Truth About the Health Care Bills – Michael Connelly, Ret. Constitutional Attorney
Well, I have done it! I have read the entire text of proposed House Bill 3200: The Affordable Health Care Choices Act of 2009. I studied it with particular emphasis from my area of expertise, constitutional law. I was frankly concerned that parts of the proposed law that were being discussed might be unconstitutional. What I found was far worse than what I had heard or expected.
To begin with, much of what has been said about the law and its implications is in fact true, despite what the Democrats and the media are saying. The law does provide for rationing of health care, particularly where senior citizens and other classes of citizens are involved, free health care for illegal immigrants, free abortion services, and probably forced participation in abortions by members of the medical profession.
The Bill will also eventually force private insurance companies out of business, and put everyone into a government run system. All decisions about personal health care will ultimately be made by federal bureaucrats, and most of them will not be health care professionals. Hospital admissions, payments to physicians, and allocations of necessary medical devices will be strictly controlled by the government.
However, as scary as all of that is, it just scratches the surface. In fact, I have concluded that this legislation really has no intention of providing affordable health care choices. Instead it is a convenient cover for the most massive transfer of power to the Executive Branch of government that has ever occurred, or even been contemplated. If this law or a similar one is adopted, major portions of the Constitution of the United States will effectively have been destroyed.
The first thing to go will be the masterfully crafted balance of power between the Executive, Legislative, and Judicial branches of the U.S. Government. The Congress will be transferring to the Obama Administration authority in a number of different areas over the lives of the American people, and the businesses they own.
The irony is that the Congress doesn't have any authority to legislate in most of those areas to begin with! I defy anyone to read the text of the U.S. Constitution and find any authority granted to the members of Congress to regulate health care.
This legislation also provides for access, by the appointees of the Obama administration, in direct violation of the specific provisions of the 4th Amendment to the Constitution, of all of your personal healthcare information, your personal financial information, and the information of your employer, physician, and hospital. All of this is a protecting against unreasonable searches and seizures. You can also forget about the right to privacy. That will have been legislated into oblivion regardless of what the 3rd and 4th Amendments may provide.
If you decide not to have healthcare insurance, or if you have private insurance that is not deemed acceptable to the Health Choices Administrator appointed by Obama, there will be a tax imposed on you. It is called a tax instead of a fine because of the intent to avoid application of the due process clause of the 5th Amendment. However , that doesn't work because since there is nothing in the law that allows you to contest or appeal the imposition of the tax, it is definitely depriving someone of property without the due process of law.
So, there are three of those pesky amendments that the far left hate so much, out the original ten in the Bill of Rights, that are effectively nullified by this law. It doesn't stop there though.
The 9th Amendment that provides: The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people;
The 10th Amendment states: The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are preserved to the States respectively, or to the people. Under the provisions of this piece of Congressional handiwork neither the people nor the states are going to have any rights or powers at all in many areas that once were theirs to control.
I could write many more pages about this legislation, but I think you get the idea. This is not about health care; it is about seizing power and limiting rights. Article 6 of the Constitution requires the members of both houses of Congress to "be bound by oath or affirmation to support the Constitution." If I was a member of Congress I would not be able to vote for this legislation or anything like it, without feeling I was violating that sacred oath or affirmation. If I voted for it anyway, I would hope the American people would hold me accountable.
For those who might doubt the nature of this threat, I suggest they consult the source, the US Constitution, and Bill of Rights. There you can see exactly what we are about to have taken from us.

The way it stands each and every one of us is going to feel the sharp sting of this in the coming 24 months.
I currently have GREAT (my son, a VP of one of America's largest healthcare firms, calls it the best he's ever seen) health insurance. I am well aware that my costs, when the employer mandate hits, will at least double, my choices will be minimized and, as a "senior citizen" (yep, I now get the movies cheap) I'm going to be yielding lots of important decisions to bureaucrats.
My insurer, through my employer (one of the largest firms in the country) has, already been requesting the mandated information about my BMI. waist girth, smoking, alcohol, drug use and sexual gender preference. At this point I've declined to answer but I'm not unaware that having a BM! above the normal range is going to either cost me a fortune or have me denied certain coverage. Frankly, if you are 60 years old and wearing anything above a 30" waist in your Levi's you're at risk. If you smoke kiss your ass goodbye in terms of certain health care elements.
I can only hope that folks are already finding ways to get involved.
I've had to seek out my local Republican organization (trust me, it;s not great, but it's the best available choice at this time . . the Tea Party and Libertarians are nothing but vote splitters. As much as I may like some of their ideas, 15% of the vote isn't enough to do anything but insure the Republicans loose) and get involved. I make small donations, offer to help as a volunteer and do whatever I can. None of us need to do anything big . . but we DO need to get involved.

While I agree with you on the Libertarians at this point, the Tea Party seems to recognize this problem and are trying to affect change from within the Republican party. Please note that (at least to my knowledge) there is no actual nationally recognized Tea Party organization. Despite what many have said, it really is a grass roots movement.

The first is to simply point out that the system doesn't work and sensitive information that you provide to the government simply isn't secure.
The second is to point out that Kathleen Sebelius perjured herself in front of Congress when she stated that Social Security numbers are not kept by healthcare.gov. If this were the case, then this persons SS# could never have been sent to another party.
Third, when they claim that this is isolated, it's a lie. The whole purpose of a computer is that it can perform repetitious tasks extremely quickly. This is true even when it is performing the task incorrectly. What the computer does not do is make a "mistake". It does exactly what was written in the code. It will perform that task as many times as you ask it to, the same way every time.

Interesting that a private company has put out a website that can actually do what healthcare.gov is supposed to do. It actually works too! Of course it's kind of hard for me to compare it to healthcare.gov, as I have not yet managed to get it to work for me beyond very rudimentary things that are clearly flawed. I bet it was done at a fraction of the cost to boot.
Amazing how much better it works, just went through it. Sad part is my family is still looking at getting raped by these crooks. Sad days to be a "working American".
Mike I feel your pain I aint made any noise when I fart for awhile either my premium is $1025.00 a month with a $4500 deductible and 30% coinsurance no dental no optical $35 copay and no prescription plan. So every time I go to the doctor I am droppin $60-$100 and forget about the fargin hospital!!!! What is considered affordable these days I wonder?????

Once you get past the dial 1 for English and getting someone with a heavy accent that is hard to understand, AT&T does a great job with service. The PPACA / ObamaCare has always been about granting care to illegals, remember this is the ONLY instance that Illegals are specifically denied by letter of the law.
