English Electric built a plane called the Lightning in back in the 50s/60s & lockheed in WWII with the P38. I fail to see how they can buy a word. I mean what's going to happen? are they going to sue all the weather people if they don't pay a royalty every time they use the words. And what about existing copyrights? Bohemian Rhapsody anyone? "Thunderbolts & Lightning very very frightening be..." Will Queen be suing Apple for plagiarism? Will there be a secret app on your i-phone that bills you every time you utter one of their words? Had a crappy day so I'm feeling REALLY Grumpy. |

IP law is funny. And by funny I mean incomprehensible and not based on common sense. |

Hell if Apple can sue over another phone having rounded off corners, they can sue for anything. Monster Cable a few years back went on a frenzy suing everything with Monster in the name including the energy drink. |

Doesn't a suit of this kind require that a reasonable customer might confuse the two products? Pretty hard to confuse a motorcycle and a computer port.... |

My first bike was a BSA Lightning and the 500cc version was a Thunderbolt. |

Pretty typical for HD. What other company would buy MV Agusta for $xxx, xxx then sell it at a pretty good loss six months later. I for one are very glad we're shed of them. Onward & upward EBR. |

"Doesn't a suit of this kind require that a reasonable customer might confuse the two products? Pretty hard to confuse a motorcycle and a computer port" That was my first thought (Apple the electronics manufacturer and Apple the record label aren't a conflict). But the article states that HD owned the trademark rights to the names for appliances and electronics in addition to motorcycles. They did not sell the motorcycle rights. |

I'm not sure if you are aware, but those two have had numerous litigations over the years. Apple Computer originally came to an agreement with the record label because they were two separate industries, but after the iPod and iTunes came out things got messy, I don't recall the outcome off the top of my head, I'll have to check into it again. |

Yes, I'm aware, but the courts decided that there was no conflict. This is why Apple the electronics manufacturer is able to sell music. They're not a record label, simply a retailer. |

I'd say it's all a lot of B*ll*cks, but that's probably trade-marked too somewhere. By the way, I found a Golden Apple at the side of the road the other day, started to buff it up, there was a puff of purple smoke & out popped a genie. I said to it "I thought Genies lived in lamps" He replied "Yes we did but Apple took us over & remodelled the lamps to look like apples, oh & we're no longer called Genie of the lamp, now we're i-Wish!" |
