Third degree burns and didn't feel it??????!!!! Lack of common sense not to check the bench before sitting down??? I sat on a hot bench once.........once........I also stood up right away. Reminds me of the McDonalds coffee woman. |

3rd degree burns? Really? She was charred as a result of this? I just don't see how a person could get third degree burns from a hot bench. |

Look . . . you're in Texas . . . I had an office in Dallas for years and a house in Zapata county . . . it's smoking hot and, just like using a glove to open a hot car door, any person with enough sense to come in out of the rain (which this gal may well have lacked) knows better than to sit on a hot metal bench. Pure and simply . . . Darwinism. The only saving grace is that in Texas I think she can only sue for "actual" damages . . which would be, at best, a couple hundred bucks of ER treatment. It's the fact that she's even SUING that amazes me. Gads. . . |

The McDonalds case was laughed down by the media. But the coffee was served at that location was hot enought to cause third degree burns in 2-3 seconds. When spilled on the lap of an elderly woman it did this... Bet ya never saw that side of the story before. I hadn't until I saw that documentary. Google it, there is a different photo that shows the damage between the legs but I didn't want to post it. It's blurred but still borderline NSFW. Being dumb enough to think you could get away with the 'safety' of a plastic lid without it spilling on you as you cram it between your legs - priceless - apparently. I wish she has just stayed in bed that morning, or not worn nylon track suit - notice they didnt get sued. stupid is as stupid does. Social Universal insurance guarantees your premium will suffer the consequences of a slew of Estelles; as too will fall the nation. Because of her - Wendy's will no longer dispense Hot drinks through their drive through in Washington state. |

Prime example of how that coffee story was completely misrepresented by people that wanted to showcase it as an example of a frivolous "get-rich-quick" lawsuit. The woman was not driving the car and it wasn't moving. She was in the passenger seat, her grandson was in the driver seat, and they were stopped. She originally only wanted $20,000 to cover medical expenses and lost wages. She wasn't trying to get rich. McDonalds offered $800 and refused to settle in court. Before her suit McDonalds had also recieved over 700 reports from people being burned by their coffee and had already paid out $500K in other cases. This new case in Texas is different though. It's not like the owners have directed thier employees to keep the bench at a dangerously high temperature. It's being heated by the sun. Sure, they could be nice and put something over the bench to shade it. And if they have had numerous complains about the bench(s) burning other people then they should have already acted. But it's possible this is the only time it's ever been bad enough for someone to say or do anything. |

" Funny you mention this City....in the movie they state something that wasnt spoken of much - she was a passenger, not the driver. Passenger in a parked car. Does that make it better for you? It kills your 'negotiate a vehicle' stuff And thats just it, the media put a spin on it and we all called her an idiot, but not all of the facts were in the news The coffee being served was WELL above a safe level, as stated above, it caused 3rd degree burns in seconds. And as much as you probably do not beleive it, she wasnt driving. It wasnt like she had one hand on the wheel, one on her cell and trying to drink her coffee all at the same time. No, she was a passenger. Hearing these things, does that change anything for you? It should, cause the 'facts' you are spewing, simply, arent facts. Again, watch the doc and you might have a change of opinion. The bench suit seems weird to me that she didn't realize she had third degree burns until later. I'm wondering I this a very over weight person? I'm not making a joke. It makes more sense if the person was so big that she had difficulty getting up from the bench thus making the burns more severe. And also maybe he extra size would make seeing the damage difficult without help. Regardless I would imagine the pain would make you seek immediate medical attention. There is very little information so it's all speculation. |

The McDonalds case was decided because the company deliberately served crappy coffee very hot, which masks the crappy. That was well documented in the McDonalds instructions to the stores. They deserved to lose, since it was deliberate that the coffee be hotter than "normal". They have since both much improved the coffee, and dropped the serving temp. Some one in Dallas that sat on a black rock on a sunny 100 deg. day? Not in the same league. The possibility that she is obese? Pure speculation, and a bit mean. Might have factual merit, if true, but the news story has no picture or other detail to fit. Burns are weird. The shock to the nerves often shuts down the pain quite a bit, so folk don't know how bad it is. The pain comes back with a vengeance in a bit. I've done first aid work for years at campgrounds and martial arts tournaments. Dealing with strong willed people who don't think they are hurt as bad as they are, with no authority to make them behave........ All you can do is recite the mantra "if discomfort persists, see your doctor"...... Guys I was pretty sure had broken bones who just want a wrap and get back to fighting. Folk that drank too much after a day in the hot sun working hard with not enough water. ( When the lady you are working with is driving a knuckle, hard, into the breastbone of the drunk girl trying to get a reaction & get her metabolism up enough to keep her alive until the ambulance arrives... That's terror. ) And burns... burns are weird. |

I didn't mean to be mean or hurtful. Just speculating on why a person might not immediately stand up after sitting on a scalding hot seat. Could also be elderly or handicapped in some way but I'd imagine that would make it into the story. If they were wearing short shorts or really thin fabric it might only take a second or two to get burned but I think most people could still get up fast enough to avoid such severe burns. |

you can fiddle faddle yur fat old self in the passenger seat well enough. The first time I heard it, she was "driving" then I had a warranty law class that reviewed the case in detail. Cup holders STILL would have solved the problem. Wearing a bad track pant suit contributed to the way the liquid pooled and ran And now we all need to reminded - Hot Coffee is um, HOT. The coffee was with in spec range for a FRESH pot were it me, I would have paid her med bills, and DEDUCTED the amount of cost for bad fashion, cup of coffee, cost of cupholders and Charged her driver of negligence. Further, I would let every business that is now required to carry 'Estelle' Coffee insurance SUE her in class action recoup. but that is me. and the girl on the bench - I would put her name on it and dedicate it to her in eternity. and bounce her out of court too. |

She bought coffee. She spilled coffee. Her fault. Don't spill coffee. What if she made her own coffee? Would she then sue the manufacturers of the cup and/or coffee maker? After all, we don't control the temperature of the machine, and we also don't control the cup's ability to retain heat... Right? What about the engineers who designed the cup and/or coffee maker? Surely they are responsible for negligently creating such things! Perhaps none of us can be trusted with anything more than a cool, bland nutrient paste. And we should all wear safety suits that have a single zipper down the side with attached booties and mittens. The woman was a klutz and got burned as a result. Period. |

I have reconsidered my position. The zipper on the safety suit would obviously be far too dangerous for public use. We will dilute the nutrient paste into a transdermal liquid and we will all be suspended in a plexiglass capsule. |
