or at least have someone you can talk to face to face that knows it.
That's a picture of the car that just rear ended my buddy a couple of weeks ago. This isn't a Geico, Progressive, Dairyland, etc is better than the other thread it's a don't get yourself into this mess thread. He was completely stopped waiting on traffic to make a turn with his girlfriend on the back when a 19 yr. old never hit the brakes doing 50 in a 35 about 300 yrds from my house. Girlfriend landed on the windshield and he went flying with the bike, both had to be taken to the hospital overnight. He was knocked unconscious (both wearing helmets and gloves) and woke up the next day. He has health ins. (LEO) but the girlfriend does not. Bike was a total loss, at fault driver was insured. Turns out Geico didn't tell him about the need to file a rejection of PIP form which is required by state law. He did what most people do, called Geico because they were the cheapest, got his insurance, got into an accident and is now basically screwed because "If a no-fault rejection form is not filed, he/she will be unable to recover the first $10,000 of a motorcycle injury claim from the at-fault party." (Taken from the Ky.gov dept.of Ins.) All I'm saying is, know what you ins. will do for you in case you have an accident. I get my ins. from a brick and mortar store and know my ins. agent on a first name basis because if this happens to me I want someone there I can go and talk to and someone who knows the laws of the particular state. And that earlier thread about motorcyclists being 100% at fault in an accident, I think this proves BS. |

Glad to hear they both made it out of this relatively ok. Could have been much worse. Wife currently works for an insurance agent so she is obsessed with making sure we have the right coverage because she has seen too many times what happens when you don't. |

I talk to my insurance carrier and health care provider on an annual basis (because I forget what they've told me, lol) to confirm that I'm not left out to dry. |

If his state law requires the form and if his agent at Geico did not inform him of this requirement then he might be able to go after the agent through the agent's Errors & Omissions insurance. Have his attorney look into it. |

First I am glad they are OK. Second I said it was the motorcycles fault 99% of the time. What part of the lane where they in? When ever am the first one to have to stop for a red light I make sure I am as far left on the center line as possible. Saved my life last week when somebody did the same thing to me as was done to your friends. Had I stopped in the middle of the lane I would not be typing this today. I always give the idiot behind me the out to the right, away from head on traffic. I will never pull up to stop at a light on the right side of another bike for this reason. Doing this has saved me at least 5 times in the last few years. What we were taking about in the other thread is that you should be proactive in making sure to not put yourself in the wrong situation so that something like this wont happen to any of us. |
