I just saw that too. Seems like a blatant disregard for our Constitutional rights. This is one of the few cases where I agree with the ACLU!

It's like searching your car. If you consent to the search, they can do it.

If you do not consent to the search, they need probable cause to search anything of yours.

Unless you are taking about the Border, then border search authority applies and they could search you phone without a warrant or cause.

No one is going to grab your cellphone and download its contents unless he/she has a warrant. If it gets to the point that they have a warrant for your phone you're probably f'ed anyway.

As mentioned before the border search authority does not require a warrant, but all of us who've traveled internationally know that. Carry something into the country and you can bet it'll be inspected.

That's nice in theory. I've been the recipient of non-consenting searches from the Michigan state police before. Twice.

Once was with a friend who though he knew his stuff because he was studying law enforcement in school and told the officer he wanted to see a warrant. That encounter had us walking back to the car in a snow storm from the police station. The police were kind enough to leave the car sitting with the doors and trunk wide open and ALL contents of the car sitting in the snow.

Bottom line is that the guy holding the gun can trump your civil rights.

youd be surprised how dumb gangbangers can be...they take pictures of their contraband, guns,and places where they hide their guns/ drugs, ect on their phones. you'd be surprised how much knowledge can be gained by checking a cell phone.

Hate to tell you this but,as of now courts have ruled that cell phones are no different than any other container in your vehicle, and if your phone is in the vehicle when you consent, or searched under PC, then the phone can be searched. I suspect this will change as more and more phones turn into little computers, but thats the way it is for now.

Politely decline is what I did the second time. They still searched my car. Eboos may be right, but how much money are you really going to throw at suing a state government over something like that. Back then I don't think I could have gotten a lawyer to take a case with the assets I had. Today I could swing it to a point, but would still run out of funds if the state wanted to fight.

Yes they can be. I've still met more good ones than bad. Somehow I've had bad experiences in Michigan though. There could be a correlation with being an out of state driver that does a lot of miles in MI though.

Lawyers like high profile cases or cases where big cash judgments are likely. When you are searched and released there's it's not a case that is really going to get public attention. What exactly are my "damages" that will get a big financial settlement? The lawyers who take these cases do so because there's likely a payout down the road. I can't even claim a case of driving while black.

Bullshit. Pure bullshit. I do not have the money to engage in a court battle. 95% of people don't have the money or the time and "THEY" F'ING KNOW THAT!!!! Even if they did not "politely" decline, there is no excuse for putting people in a dangerous situation by forcing them to march in a snow storm, and leaving their belongs outside the vehicle, none at all. And don't even try going with some: They could have called a cab BS.

I grew up on the "wrong" side of town. When I was a kid, if a police car drove down any of the streets in my neighborhood, people would call across back yards to warn everybody.
I find people's reactions to this bit of news interesting.
I don't know how many people from my neighborhood "Tripped while going down the stairs".

This piece of equipment is an investigative tool. Bad people general have bad friends. It'd be nice to have that terrorist's friend's phone number. Or how about that picture you took on your cell phone of that grow house, phone's attach a GPS location to alot of pictures. It may not be illegal to have a picture of marijuana, or a criminal's phone number, but it could further an investigation. If you give me an innocent person's cell phone number, I cannot turn them into a criminal.

Know who else has these tools, phone stores. I saw one at Verizon Wireless when I bought a new phone. That's how they transfer data from the old phone to the new phone. Think somewhere in the country, a phone tech saved a picture, or something from a customers phone they weren't supposed to. How about we write an article about that?

Plain and simple, if you consent to search or an officer has PC, your phone can be searched. If you do not consent, or the officer does not have PC, then the search violated your rights and nothing is admissible in a court of law arising from said search and seizure.
