As read on another MC board. Scary. There is currently a Senate Bill (5544) being considered VERY SERIOUSLY by legislators that will make illegal - in WA state only - riding and racing offroad motorcycles AND even street bikes on paved tracks . This will include motarding. If passed, this bill will put Pacific Raceways, motocross tracks, supermotard, the new NASCAR facility, track day companies, and WMRRA out of business... all will be done. If you think this is in question, then note the comments of Jason Fiorito, owner of Pacific Raceways, on 710 KIRO this morning. He said if this bill passes, PACIFIC RACEWAYS WILL BE PUT OUT OF BUSINESS. This bill is not just against offroad motorcycles, according to representatives of CLOUT and WOHVA: it will apply to all virtually any machinery (ie. cars, snowmobiles, 4 wheelers) operating on anything other than public roads. Think your private track on your own land is safe? Wrong: even private land is included in the bill. Dirtbikes, track days, motocross, snowmobiliing, four wheeling, dune buggies, motarding... the representatives I have been in touch with today say all are at risk if the Sierra Club, WTA, and the liberal politicians we somehow put in office get their way with SB5544. And right now... they're on a path to getting this thing done in an effort to accomodate the environmentalists, their money and their votes. If ever there was a time to be proactive folks, to not let others do the work, to not make the excuse that you're too busy, it is now. This is VERY, VERY SERIOUS according to many in the know. So there are several things each of us needs to do, and do now. Do not delay. They are: 1. Spread the news. Tell your riding buddies, and then tell them to tell their buddies. And then make sure everyone ACTS. Email this news to as many people as you can. If you post or belong to other forums, make this known: post this same information and get the word out fast. 2. By the way, several OHV representatives contacted the offices of Kline today to see if he actually wrote the email, and he personally told them "yes, I did." Stunning. This guy has waved his middle finger at the motorcycle riding community... which is you. 3. Write your senator and legislators telling them that SB 5544 must be stopped, that it is blatant discrimination against motorcyclists and OHV'ers, and you won't stand for it. Put "Con SB 5544" in the subject line, and tell them you want to be contacted on the matter. Be courteous, but be firm. Make your voice heard. Here's how: http://apps.leg.wa.gov/DistrictFinder/Default.aspx. This step takes maybe two minutes, and it is the most important of any of these. 4. Attend the March 9, 2007 OHV Rally in Olympia at noon. Be there: don't make excuses. You need to attend. And your friends. And your kids. 5. Get yourself and your PRO-OHV friends to send an email to clout@hpgmc.com with "CLOUT" in the subject line along with their name, their voting zip code AND your name as a reference. This will get you and your friends signed up to receive email alerts on this matter, and that's all there is to it. Get them to do this TODAY so motorized recreation will have a stronger voice in Olympia: we're a whisper compared to the yelling of environmentalists. They're winning folks: the spotted owls are more important than you. We're in serious trouble: the environmentalist lobby, their dollars, and the volume level of environmentalist voices is much larger than ours, and politicians are acting on their wishes. If you do #1 through 5 above, we might have a chance. Please don't reply saying I'm full of it, that the bill doesn't apply to motarding and sportbike track days and so forth: attorneys today confirmed that it likely does apply if the current wording of SB5544 is not ammended. That's why Fiorito was on the radio: he's scared of what this will do to his entire facility and ALL his tracks, not just the motocross track. ...why, why, why, do folks insist on motorized "sports"? Those two words are an oxymoron. There is nothing sporting--athletic, physically demanding--about riding any machine anywhere... ...I would be happy to ban the use of the internal combustion engine off-road, by anyone without a handicapped sticker, subject to a stiff fine. Maybe we could call this an anti-obesity measure. Please circulate this to all motorized sports enthusiasts, so they can remember never to vote for me. Basically if you own one of these: "Nonhighway vehicle" means any motorized vehicle including an ORV when used for recreational purposes on nonhighway roads, trails, or a variety of other natural terrain. Nonhighway vehicle does not include: (a) Any vehicle designed primarily for travel on, over, or in the water; (b) Snowmobiles or any military vehicles; or (c) Any vehicle eligible for a motor vehicle fuel tax exemption or rebate under chapter 82.36 RCW while an exemption or rebate is claimed. This exemption includes but is not limited to farm, construction, and logging vehicles. You can't do this: "Nonmotorized recreational user" means a person whose purpose for consuming fuel on a nonhighway road or off-road is primarily for nonmotorized recreational purposes including, but not limited to, walking, hiking, backpacking, climbing, cross-country skiing, snowshoeing, mountain biking, horseback riding, and pack animal activities. The time being spent to conjure this bill, which obviously infringes on Washington's residents' civil liberties, is one of the most ridiculous abuse of tax payer's money I have ever heard. Outrageous! Time limit on noise generated by a "Nonhighway vehicle": NEW SECTION. Sec. 6. A new section is added to chapter 70.107 RCW to read as follows: (1) Except as otherwise provided by this section, no person shall cause or permit noise to intrude into the property of another person with noise that exceeds the maximum permissible noise levels set under this chapter. (2)(a) Noise from the combined activities of the starting, servicing, idling, revving, testing, or use for ingress or egress to allow sale or repair of a vehicle may be allowed as a duration exemption without violating subsection (1) of this section. (b) To qualify for the duration exemption permitted by this section, any noise emitted: (i) Must not exceed the decibel limits established under this chapter by more than ten decibels; and (ii) May not occur for more than five minutes in any one twenty- four hour period between the hours of 7:00 a.m. and 10:00 p.m. If there is more than one vehicle involved, the five minute limitation applies to all vehicles combined. (3) This section preempts any duration exemptions adopted under RCW 70.107.030(2)(b) that exist now or in the future as applied to the operation of nonhighway vehicles in residential areas. Why not ban pistol ranges and barking dogs while they're at it? Have there been studies conducted on the number of complaints submitted for noise created by "Nonhighway vehicles" to warrant such a bill? Senator Kline has that waterhead or child molester look about him. Whatever, what a nut job. We have a really liberal wacko legislature here in Maryland but that is one crazy proposed law. However, I doubt the provision to ban use on private land would stand up under a constitutional challenge. That being said, it doesn't prevent these liberals from trying. They passed two laws in my state last year that ultimately were challenged and deemed unconstitutional. Why not ban pistol ranges and barking dogs while they're at it? Correct me if I'm wrong but I do believe they tried that in our state, Ras - that is, to ban pistol ranges within so many feet of a residential neighborhood and I'm pretty sure up in Balto City a barking dog can get you a fine which brings another thing to mind about the city. It's illegal to even own a dirtbike or an atv. If they see one in your yard they will come confiscate it. It's designed to stop the yoddle-heads from riding in the streets but they still do it. |
