Reckless Driving + a Death= Vehicular Homicide, Second Degree Felony. It's not a whole lot more complex than that even without the booze or drugs. Drunk or sober, he's still in for a world of trouble here in Fla. |

And then there is the worthless scum bag fat cat politician up in South Dakota who ran a stop sign and murdered a biker. Jankow, a chronic offender for speeding and reckless driving, got convicted but then proceeded to use his political pull to get himself absolved from any financial liability and weasel almost completely out of the punishment. Hopefully, Billy Lane shows some measure of sincere remorse for needlessly killing a fellow human being. At least if he was drunk he had reason for being S T U P I D and trying to pass 2 cars on a double yellow line. In a heavy truck. Its not like he was on a high performance bike or sports car. Were he might have a slight chance to build speed quick enough to pass two cars on a double yellow. Legally. He is done. A good lawyer will pull video tape of him drinking, shirt less, and doing a burn out. He will lose a large portion of his assets from cival suit. |

Do you know that to be true? It seems like he should get a worse sentence if he was sober... My observations here in the state of Colorado, the motorist would get a slap on the wrist if they were sober. Last (sober) gal who killed a biker here got 18 months probation, never spent a day in jail, and has no restrictions on her license. Recently, a drunk illegal immigrant in Boulder with 11 prior arrests killed a biker and fled the scene. He was caught, charged with "reckless driving resulting in death" and released on $350 bond. You might not believe this, but he didn't bother showing up for his court date. Boulder Police believe he has fled back to Mexico. As long as we're on two wheels, the public and the Law looks on as we're murdered with indifference. |

The general lack of accountability for drivers is bad enough in many states, but some seem to think that less punishment is in order when a motorcycle is involved. Like the biker is assumed to share the blame or have contributed to the accident. There are some nauseating "slap on the wrist" examples here on the AMA Rights for All page. Jack |

Permanent license revocation should be in order if DUI causes a fatality. I doubt that would ever become law, but it should. |
