well, i was going to work at 6am and a lady on a freeway decided she didn't have t oslow down and could clip me goin 70. accidents happen, i wish people were more biker aware, especially in houston TX.. ANYWHO....i ended up breaking my left femur and had to spend 3 weeks on a respirator because of some complications (bone marrow travels into lungs and makes things real dirty i guess). well, the good news is that im out of the hospital and alive(one point they didn't know for sure if i was gunna make it, lots of prayers helped me through). Can't walk, gotta get surgury on my knee but my leg is stronger than before), i have about 6 months of rehab before. ANYWAYS, i can't wait to get back on 2 wheels! my s2 totaller her car, s2 took some heavy damage..i dont think its fixable but we'll see, all in due time. what do i need to do insurance wise? she was completely at fault, and id like to get as much money as i can but i do know accidents happen and im glad to not be dead. |

1. complain to the doctor about everything. it must be on record so complain and get it in your medical record. 2. you can only get the amount of insurance money the person had purchased. So if she only has a 50k policy then thats the max you'll get. After that you must sue her. 3. you can also file on your insurance provided you have uninsured insurance on your policy. 4. don't talk to her insurance company on record untill you get more advice.. What Ryker said, get it on file, every little pain could show up later down the road. If you got it on record, you will have more evidence to win your case. Call a lawyer ASAP. Don't wait. They know how the game is played with regards to insurance companies whereas you don't. You are at a huge disadvantage without one. I know people who tried to handle accidents on their own and they regretted it later. |

Scott - glad you're still here to tell the story and that you're healing up. You had fat embolisms in your lungs. Basically tiny droplets of the fat from your bone marrow entered your blood stream and was carried to your lungs where they clogged up some of the small blood vessels. That's always a concern with larger fractures, especially high impact fractures. Heal well and keep us posted. Henrik |

welcome home, get a lawyer, watch the internet for s2 parts. no matter what, buy back the salvage from the insurance company. you have first rights. if it's not rebuildable it is still a good basis for extra parts in the future. titled s2 frames come up occasionally and there are a lot of spares in badweb garages. best wishes for your recovery. tim |

That's always a concern with larger fractures, especially high impact fractures yea, that is exactly what happened...luckily i was taken to houston's BEN TOP medical center which is an amazing trauma center and they had this really cool respirator which saved my life.. being critical condition definately was a scare for my loved ones and friends but im lucky im back in one piece (mostly). the adjustors suppose to look at the s2 next week, im expecting it to be tottaled and to get 3500-4500$ for it...its in rough shape, but so was her SUV :-D! thanks for the advice everyone, im getting a little more mobile every day |

You were nearly killed because of the negligence of a driver in an SUV and need to be fully reimbursed not only for your lost S2, but for your medical bills, deductibles, lost work, and pain and suffering. |

Man, those embolisms are a bitch. I was recovering from a broken tib/fib compound fracture in a bike accident and noticed I was getting tired easily with little effort. I just chalked it up to too much stress and little sleep. One morning my wife says goodbye on her way to work and freaks out because I was literally blue in the face. She rushed me to the ER where a CAT scan revealed massive blood clots (embolisms) in both lungs. The clots broke loose in my leg and collected in the lungs where bigger ones formed. It was close for about a week. They put me on blood thinner drugs for 6 months and installed a filter in the main artery between the heart and femoral arteries to catch any subsequent nasties. The doctors said that they now use my CAT scan pics in medical training sessions at the hospital. The official student prognosis for my scans is "deceased". That kind of creeps me out. Didn't mean to 'jack the thread, but some folks don't realize that complications from a simple broken leg can kill. Glad you're OK. |

yea man, i guess its a pretty common thing to happen with a bad fracture and the surprising thing is there is not much they can do except put you on life support and hope the embolisms clean themselves out....i was criticial condition for about a week, funny part is i had no idea this was goin on though. |

OK a lawyer --- Like I've said before you can only get what the lady has insured for.If she only has a 100k policy then the MAX you can get is 100k. Even a lawyer would only be able to get 100k unless she has a nice job or a house then the lawyer can sue her. Most people have less than 100k policy. So thats 100k minus the hospital bills and your bike. After all that is what your left with. If you get a lawyer he will take 25-33% of the 100k off of the TOP. So he would get say 30k then he will take off expenses from your 70k (phone call, faxes etc etc) Now your down to 65K. From that 65k you then must subtract the hospital and motorcycle. -- If you only knew how much she was insured for? __ If you choose to handle it yourself. It will take at least 6 months after all of your injuries are healed. The insurance company will do everthing the can to delay and stall the outcome. So keep a log book of dates and times of each phone call. Copies of any letters sent or recieved, or faxed. If possible try and use email. Email is hard evidence of what they say. If your state allows is record the phone call. After a few months of letting them jerk you around go see your states Insurance commisioner and complain. Beaware of any check they send. It could contain fine print "full and final realease all claimes and leing" cash that check and your %$^&#*. If you get a lawyer be sure you know where is % come from top or bottom and if it includes fees. Your case is pretty clear and its not like your faking anything so a lawyer won't have to do much more than make a few phone calls. |

her personal injury was 100k$, i already hit 92500 in my 3 week hospital visit. luckily, i do have insurance through my work but unfortunately i still have a lot of work left on my knee. lawyers are getting called today, and i get an MRI on my knee tomorrow. ill keep everyone posted |

insurance through your work --most of the time it becomes secondary insurance. Your health insurance will not cover the damages due to an auto accident. They will want to recover any $$$ they pay from the ladies auto insurance. If you have full coverage auto insurance with under/uninsured coverage then you can file a claim on your own policy. If she only had a 100k policy -- then unless she as a great job or a $$$$$ house you probably won't get a fair amount for your body. Which is why I limit my riding since I am a student and can't afford the high insurance policy. Once I can afford it I will have a huge policy not only to protect myself but if I ever cause an accident I want to protect the injured person. Its not fair that people can cause harm and not have to pay for it. |
