A Wantage teenager was in stable condition Saturday, after being beaten with a baseball bat the evening before at a party in the township. The victim, a 15-year-old High Point Regional High School sophomore, underwent emergency brain surgery at Morristown Memorial Hospital, his father said.

State police arrested a juvenile suspect, whose name and age were not released. He was being held Saturday at the Sussex County Juvenile Detention Center, charged with two counts of aggravated assault and one count of weapon possession, authorities said.

Scott DiGuilio, the victim's father, said the suspect is a 17-year-old Wantage
boy who had previously tried to instigate a fight.

"When my son was a freshman, this kid wanted to fight my son and kept calling him names," DiGuilio said. "He blew him off ... but he didn't have any idea it would have these repercussions."

The attack took place at a home on August Lane in Wantage. The victim was hanging out in front of a friend's house when a green Jeep with one headlight pulled up and five boys wearing black bandannas got out, DiGuilio said. Two of the boys were carrying baseball bats, said DiGuilio, who said he received a phone call from his son at 9:45 p.m. Friday.

"They thought they were getting out to smash the mailbox and they had some words," he said.

DiGuilio's son was then hit twice in the head and once in the knee by one of the boys. His friend was also hit once in the torso when he tried to intervene, DiGuilio said.

State police were called to the scene at 10:04 p.m., State Trooper Jeanne Hengemuhle said Saturday.

"Upon arrival the victim had already been transported to Saint Clare's Hospital in Sussex Borough," Hengemuhle said.

After examining evidence at the scene and interviewing the victim at the hospital, officers arrested a juvenile suspect, she said.

A CT scan of the victim revealed a subdural hematoma, and he was transported to Morristown Memorial Hospital for emergency brain surgery, his father said.

DiGuilio questioned why he wasn't being charged with attempted murder.

The suspect, DiGuilio said, called the house his son was visiting several times before the attack to see who was at the party.

"It was pre-meditated," he said.

Janet Turner, the victim's grandmother, said the family wants the alleged attacker — whom she called "that animal" — tried as an adult.

Sussex County First Assistant Prosecutor William Fitzgibbons said it was "too early to tell" if the suspect will be charged as a juvenile or an adult.

"He could be charged as an adult, (but) that's a decision the Prosecutor's Office has to make after we get all the information together," Fitzgibbons said.

The Prosecutor's Office would have to make an application to Superior Court Judge Thomas Critchley Jr. to have the suspect tried as an adult, he said.

Any bail will be set at a detention hearing today, Fitzgibbons said.

The incident remains under investigation by the State Police, Hengemuhle said.

Sorry to hear this. What the f()ck is wrong with people?! My step sister was murdered last year by a guy that broke into her apartment by accident thinking it was the guy's that fired him from his DISHWASHERS JOB !!! He returned a week later and killed his former boss before he was caught. He killed her just because he was there.

I hope they hang the punk @ss that did this to your nephew. Pricks like that don't need rehabilitation.....they need to be eliminated.

yep - the matching black bandannas definitely avail 'gang' enhancements, if not coinpiracy charges, outright.
the perp is old enough to fight in a war, therefore he should be tried as an adult and made to be jamal's boyfriend in rahway for a good 5 years, minumum.

definitely sounds premeditated. There is no way this piece of S**T should be tried as a juvenile. this whole if you're under 18 you won't do time thing is abused by these punks. They were showing colors eg. bandanas and there were more than 3 of them so gang activity is clearly a factor.

I'm truly sorry for your Nephew, and your family. I hope justice is served. My families prayers are with you and yours.

KenB- actually, about 20 years ago, Sussex County, NJ had the highest reported rate of incest in the country (!).
As you know, very little of sussex county shares the bourgeois splendour of Lake Mohawk...

I am nearly in tears reading about your nephew. Why, why in the world, something like this happens absolutely is beyond my comprehension.

This type of insanity, and it most certainly is, extends light-years beyond any blame that might, in an effort to lay blame, be placed on poor parenting or a bad home life. You couldn't "parent" someone to do this if you tried. These people are animals.

At the risk of stepping out of my moto-sonna for a minute, I'll tell you that this impacts me in a very personal way.

I was the victim of what remains the largest drive-by shooting in the US. For no reason other than "we was gonna kill some honkies" I was gunned down in 1970 along with my sister and 5 friends.

After my sister came out of the coma and we returned home, I remember what seemed like an eternity awaiting trial. I remember sleeping with furniture pushed against the door, the phone ringing with threats all night and the taunting each day at one of the countries toughest high schools.

Frankly, from there, it got worse for a while and much worse during the trial.

I suspect that as a result of that I'd had an elevated aversion whenever innocent folks falls victim to anything. One the first anniversary of the World Trade Center disaster, I had to be carried from a construction site in NYC.

Combatants, you recall I spent a couple years with the USMC, are a different matter. But innocent folks have every right to remain innocent.

These people are sub-human vermin. Please do two things for me. First, give my deepest sympathy to your nephew's parents and know that he is in our hearts and prayers. Second, do everything you can to mobilize public outcry so that neither you nor your family has to walk into a restaurant in 11 months and find the assholes sitting there.

Court, that is a very warming and heartfelt sentiment and one I think we all share in. I do believe there is a blame along a line somewhere and that line draws sometimes through film and TV.

I too wish your little fella nephew well JT. Sussex County maybe, but this brutal and insane behaviour happens in Yorkshire and everywhere else in England just about every weekend, and victims do die. Sickening. Absolutely sickening.

it's true buell riders are great people..they have one in juve now...this is not his first offence !!the others were brought in and RELEAST!..i'm not sure why, but this is far from over.
SCOTT is doing great!..he's a good kid, and he has alot of good family and friends to help him out.

These small towns are breeding grounds for this kind of stuff...talk to your kids...teach them..love them...hold them..this world is not a nice place any more..and i fear getting worst.

Truest statement I have heard in a long time.. see the violence everyday at work and most if not all of it now comes from the juveniles. In speaking with my people on the street the reasoning is the lack of prosecution and minimal jail or detention center terms. Then they can get a youthfull offender status and have their record exponged. The main reason I see in all of this is the glorification of this "gangster" lifestyle portrayed on television and most other media. To take these wanabe thugs into my neck of the woods would be an utmost pleasure. I would guarantee the tears and cries for mommy would start within minutes. Tony... I'm glad he's doing ok and like I said before if you need anything dont hesitate to ask. As for the release of the others... No clue there and from the article posted there should be no reason for their release unless they arent being charged at this point. Which leads me to believe that they arent charging any of them with the gang assault 1st degree, which in N.Y. states "with intent to cause serious physical injury to another person and when aided by 2 or more individuals actually present, he causes serious physical injury to such person or to a third person". Fits the bill in my book. Get on this if at all possible. As it stands now it seems like the guys who have the case arent to interested. The worst case, if these guys are charged with 1st degree would be that the prosecutor knocks it down. Which would still be a class c felony.

I have a 6 y/o nephew. His dad was a deadbeat before anyone said the word GO.

I can see the call of the "dark side" in his eyes sometimes......he's only in first grade. I have to believe that our family strength will pull him through(grandparents and I). He's all good so far, and we are watching close.

To take these wanabe thugs into my neck of the woods would be an utmost pleasure. I would guarantee the tears and cries for mommy would start within minutes.

(p.s. I gave him a quick ride on the back of the Buell, and I believe, at this point, it was the highlight of his life.....yes, he had the grin)

there are a bunch of Junior high kids in the area that are teasing my step-son. I keep telling him to not do anything back and to let a parent know as soon as it happens .. and at that point we call the police ... in light of everything happening it is too risky to say anything to them or their parents .. I feel guilty as hell about sending the police into a situation that I would not put myself .. and yes . I know it is their "job" ... but sucks when you and your immediate neighbors buy nice houses and there happens to be a double wide within walking distance with nothing but trash that has to come over and intimidate the little kids in the area ...... oh well just a little rant ....

I hope that all goes well for your family and your nephew ... Can not imagine what I would be doing if it were my son ... well, yes I can ... can you spell s-n-i-p-e-r .......
