I'm thinking not.

ECMs on 08+ models are much different than the 07 and older models.

Different programming. Largely due to such things as the newer bikes having a crank sensor rather than a cam sensor. Plus the newer fuel injection.
Not to mention that the newer ecms are much faster and more powerful when it comes to calculations.

You'd be better off getting ecm spy and a cable and tuning it that way. Or find some one who can tune it if you're like me (deathly afraid of f.u.b.a.r.ing my bike).

On a side note:

I know a Drummer works with a stock ecm on the older models (peeps here have been running that configuration for years with zero problems) so the newer, better, badder ecm on the 08 & 09 models should handle a Drummer and K&N filter with no problem.

I would.
I would get either the K&N or the Buell race filter. They both do the same thing.

The free flowing filter will go nicely with the Drummer.

On Edit: Trojan accross the pond (one of our sponsors) has a really nice foam filter if you have deep pockets.

It's high on my list of things to buy if I ever win the Lotto : )

I'd recommend NOT trying to solve problems if you DON'T have problems.

Put it on the dyno for a couple pulls once you have the engine modifications done and SEE if you NEED the ECM. You might be surprised.

Trust me, you cannot tune an engine on the internet...

Do you have a race license? You need one to get the race ecm.

You'll be fine adding the Drummer and K&N. I'm running both on my 08. Bike runs like a champ. That's as far as I'll go with performance mods without messing with the ecm.

Besides, you can't run an old race ECM on the DDFI3 engine - you'd need some other aftermarket system (search)

I know all bikes are different, but I put the K&N filter and the Buell race pipe on mine before I put on my tuner and did a base run and it was actually rich in some spots. Mostly up front but it was not bad to ride just a little decel popping.

Pete I asked Kevin when I got mine and he said no problems with the K and N. BTW I was down your way the weekend but didn't have your # with me or a 'puter.
