Hi I got hit at low speed. Minor damage to the ride. Lots of black and blue, some blood, some swelling, no broken bones. The guy who hit me was a commercial driver and is fully insured. I don't want to contribute to the high cost of insurance but I want to make sure I protect my rights. What steps should one take if they don't intend to take the offender to the cleaners but at the same time not jeopardized ones rights? I have PIP but that is all. Looking for lessons learned of others who have gone through this. |

Contact YOUR insurance company with HIS details and let them do the work for you thats what you pay them for. They will send someone out to you to look at the damage on your bike and make a quote and possibly cut you a check that day. If you havn't been looked at yet get checked out anyways better safe than sorry. I got hit and broke a thumb (knew the thumb was broken) but didn't realize I needed stitches in my elbow. Hope your not feeling too sore and hope this is helpful to you. |

Contact an attorney. Your insurance company and the other driver's want to close the books on a case like this as soon as possible. They want your signature on a document stating that they have "made you whole" and that you can't come after them in the future. You want to protect your right to seek compensation for health problems that may come up in the future. I've seen people who thought that they were just a little banged up and bruised only to later discover that they had damage to vertebrae or joints that haunted them for years. I sure hope that you're alright and that you have a full, speedy, and complete recovery. But don't be too quick to settle with the insurance company when it comes to medical claims. |
