Can you re-install the stock ECM? Harley owns the factory parts. EBR owns the new ECM.

yes i re-installed the stock ecm. bike runs fine. i think this all has something to do with turning off theft system. but i am new to bike. unsure about playing around with settings. want to use ebr, ecm so i am looking for imput on solving problem. original owner says he never used theft system.

Perhaps you could get a letter in and see what happens? I would be curious to see how this is handled. There is another post here about an 09+ electrical rotor transaction in limbo.

do you have a copy of the 1125 electrical manual? Section 5 page 32 gives a description of what you are experiencing. The ECM and Instrument cluster VIN numbers do not match, ergo, Theft Error. It can also happen if the ECM and IC have a communication failure.

that sounds like a promising lead to look into.

Check neck and engine grounds - a loose or unconnected engine ground will throw theft error as well a prevent starting. Engine ground is left side, front cyl IIRC, behind loom cover - it isn't immediately obvious.

I'd hook up the EBR ECM, back up the tune from it, switch back to your stock ECM, back up your stock ECM, and then flash the EBR tune to it. This should net you the EBR tune in your bike using the stock ECM, with no theft code. Of course this won't solve your bricked EBR ECM, but you'll have the benefit of the ECM.

Just had this happen over the weekend, I have an EBR ECM and it turned out to be a weak battery, Charged it up and everything cleared and bike was fine.

I have heard that the 08's had an issue with the instrument cluster (IC) draining the battery over time....could this have caused the problem?

If so, is there any permanent fix for this issue other than replacing with an 09 or 10 IC?

Potentially yes. Some (only some) early 08 models have the bad cluster that causes the battery drain. Only fix is to replace the cluster with another 08 or 09, the 2010 is not compatible.

The theft error usually occurs due to low voltage causing communication issues between the cluster and ECM, but other times it can be caused by a mismatch with the security settings on the cluster vs ECM.

You put the kill switch in the off position if i remember correctly this will stop the cluster drain. I think there was a post about it.
