Yes its covered under warranty. Me and a few other guys rode about 200 miles one way to meet Erik Buell at the beginning of spring. I got about 50 miles from home on the way back and mine popped off and hit a guy behind me LOL. I had to hold it up with my foot the rest of the way home which sucked.....but call your dealer. There was a recall on it and they can get you a new spring, and I believe thats the recall where they re-route a fuel overflow hose also.
Recalls should be done before you take possession of the bike, per the law. Since his was not; it was either recalled after he took the bike off the floor (and hasn't returned since), the dealership slipped up or its a warranty covered repair.
Once the kickstand program came out, it made a huge difference, but I have broken one of the new ones, too! The metal on the spring hook fatigues and fails, and that causes the problem.
ALWAYS CARRY ZIP-TIES! And, not just because you are touring on a Buell! But, because Zip Ties can save your bacon on a long ride.
When your kickstand fails, just zip tie it up through the bolt hole that's unused. Works perfect. Then, as gas stops, lock the steering and lean the bike up against a wall!
Trust me, I was an expert at kickstand failures... happened to me more times than I can count!
Man, I remember at a trackday the instructor asking me if I wanted him to bring a bucket during our ride, to carry all the parts that were likely to fall off my Buell.
I wanted to smack him, the little twerp Honda rider! I said, "That won't be necessary."
Then I crashed, and he had to help me pick up all these parts sans bucket. Serves him right!
But, I think the zip-tie thing is probably a good idea for anybody, as is having roadside assistance via AMA or AAA!
My package of zip-ties and duct tape held together the tail of a ZX-14 I came across a kid had wadded up in the twisties in Southeast Oklahoma one day.
Fresnobuell Posted on Monday, July 06, 2009 - 02:29 am: It's not a recall. It's a product program. Again, this issue was addressed long ago proactively by Buell.

Jdugger Posted on Monday, July 06, 2009 - 08:35 am: I've had about 5 kickstands on my first 08 1125r!
Once the kickstand program came out, it made a huge difference, but I have broken one of the new ones, too!
I for one have never had any issue with the side stand. Had the replacement from the product program done after about 7,000 miles on the odometer.
Note that the product program is for the side stand spring only. If you're breaking the stand itself, you're likely involved in BBW motorcycle acrobatics, and should consider a prop other than a motorcycle...
> I venture to say anyone that breaks 5 kickstands is doing something other than using for its intended purpose
What, holding up the bike?
The original kick stand spring would fatigue around the hook and break off. The new one is better, but that's where the spring failed AGAIN this last time.
I put 34,000 miles on this thing the first year I owned it.
The spring sucked, and that's why they replaced it. It doesn't hold up.
My spring flew off at some point this morning. '09 1125CR, less than 2k miles. I was making a 90 degree left turn onto another country road and heard some scraping, looked down and saw the kickstand hanging down.
I have to admit that this issue makes me very upset for two reasons: 1) a few miles earlier I was going through some left hand sweepers at triple digit speeds and a dragging kickstand could have been catastrophic to say the least; and 2) why does Buell have so much trouble with kickstands??? My old XB had the pivot screw nearly come out and a whole new kickstand assembly with updated parts was the remedy. Is the kickstand division at Buell understaffed or something?
There is a thread where Buell people are bragging there are only three recalls even when they know of these defects like rear signals but will not replace these safety items until they fail.
Buell if your reading this this keeps some of us on the sidelines shy to pull a trigger. If you will not recall these parts then please put pressure on the dealers to look these vehicles over.

My kickstand spring was replaced before it failed. There is a product program for them, as Fresno stated. In fact, I got a letter from Buell, letting me know about it, months ago.
The latest from Ducati is on the 2008 Desmosedici RR (affecting 396 units... didn't know they made that many!), concerning faulty wiring of the "main harness". Think about what might happen if the engine fuel/ignition map suddenly disappears.
If you paid close to $100k for a motorcycle, would you find this acceptable?
Quite honestly, even though I am a Buell owner, I think that it is inaccurate to suggest that Buells have more problems than other makes. If you're going to go out on a limb and state (or even suggest) that, provide some stats. Otherwise, you're going on anecdotes, and not sounding too credible.
Hey Daggar - I've not received any letter or other notification from Buell about the kickstand spring. I'm going to try to get it sorted out this week. I am a Buell 'True Believer' and this won't exactly turn me off the brand, but man, oh man, a dangling kickstand that is a well known problem concerns me.
Fresno you make absolutely no sense. Why do you flame everybody as a troll. You credibility comes off like poorly written propaganda because you will ignore clear facts.
All you have to do is read to get the facts. Buell does not have quality control with its dealers. I'm glad you got lucky, why you can you not feel for those who are less fortunate?
And why would you not want to see everyone get the same level of quality/service.
Your polishing over facts is how so many American business have gotten into trouble.
Pariah, Im saying recalls are a good thing not bad,
One could argue how many chances you get to get to get something right before you harm your credibility.
So the electronics on the 1125 were not right at release, its been 5 tries, clutch still weeps after dragging people into dealerships for new failed componet. Taillights are on what version?
Yes I'm looking hard at Buell as I want to buy American. Rotax has always had a great reputation that may actually be tarnished from this relationship not because mistakes are made but how poorly they seem to be being addressed.
Come on people, before this country manufactures nothing, be honest and be the best you can be.
Having problems is not the issue in my mind it's the inconsistent and less than frank way of dealing with said issues and spurning people for reporting issues.
Maybe this site is designed to be a corporate rallying point and not a consumer oriented site, if so my apologies for misunderstanding the intent.
Everybody? I call em like like I seem em. You constantly bang on Buell, generalize individual problems here as something that plagues all 1125rs, cite innuendo/hearsay as proof, have "Duc" in your user id & don't own a Buell of any type. Yep, you're a troll.
