Ah, great going, Big. I looked all over the DOT site and even downloaded the 38 page rulebook.
Now that I know, I cant fantasize about it in traffic though. |

In Texas it is not explicitly legal or against the law. If you are ticketed for lane splitting, you are given a violation for "riding on an unapproved surface" or some other goofy rule.
Frankly, I lane split when traffic gets below about 30, and only on the freeway. Even if an officer saw me, in the situations I lane split traffic is so backed up they would also have to be on a bike to be able to get within a country mile of me to pull me over.
My experience is cops aren't around when the traffic is bad (i.e. rush hour.) Around Dallas, during peak periods no one is able to speed, and therefore the cops can't raise revenue, and simply don't bother to show up.
Sunday morning, when the traffic is clear... watch your back. |

I tried to fight a ticket for splitting lanes in SD a few years back where I was heading to the front row of a stop light and passed a motorcycle cop (that I did not see) waiting in line with the cars. This was stopped traffic and I was going about 10miles per hour.
I showed up in court with the CHPs own literature on poster board. The one with the picture of a fat guy on a cruiser splitting lanes on a highway with no traffic. He has to be speeding! How am I not operating in a safe and prudent manner with stopped traffic, lugging my engine to the front line of a red light??
The SD cop did his thing and I did mine. I thought I was very convincing talking about operating in a safe and prudent manner, wearing gear, time of day, weather, I had visual aids etc. thanks, guilty as charged please pay the bailif. They will always side with the officer. Your only chance is if the cop does not show up. I would definitely try the written angle. it makes sense.
FWIW I still split lanes everywhere, just not directly in front of cops. And I definitely do not pass them if they are waiting in line!

OK, so today I received a correction to my citation in the mail. The problem is that the most critical item on there, my safe speed (in the officer's determination) is completely illegible. Can anyone tell me what this says?
Here's a copy of the original citation. On it he states "unsafe speed for conditions (splitting traffic at 50-55 mph)".
So can this guy just change the citation to suit his desire to get me convicted? The only thing I think that document on top might say for my safe speed is 40 mph. Too bad traffic was moving faster than that. This is unbelievable! |
