Is there any way to bid on the items without involving the internet, so that you could save the 18% fee? I mean if you're at the factory next week, can you tell an LAP rep "I'll give you $10k for the Black Lightning", win the bid, and transfer the money? |

It would be very interesting to know. This article came out yesterday: http://www.jsonline.com/story/money/2017/06/01/mot orcycle-maker-erik-buell-racing-east-troy-liquidat ed/363517001/
quote:Unable to secure other investors or a buyer, Melvin said the decision was made to liquidate. “We had numerous investors and buyers who came very close to acquiring the company in the last four months, but it didn’t go through,” he said.
I kind of wonder if the auction isn't an attempt to call someone's bluff. Perhaps someone came fairly close to what LAP said they had to have for the company but refused to go any higher. That person/company could come back at the auction and make an offer that would still allow them to buy the company intact. LAP has some real convoluted items in the auction listing. For instance, lot number 103 includes everything in numbers 1-99. Lot number 179 includes everything in numbers 110 to 178. Winning the bids on the "combination" items requires your bid to be at least 110% of the individual bids for the included line items. It's almost like that's to provide a chance for the company to survive. |

Call Melvin. I'm sure he would sit down for some figure he most likely already knows. |

I wonder what contract terms enforce the ten year requirement? Regarding Buells, we are beyond the seven year requirement that we have heard about and HD still has new batches of parts made. |

I wonder what contract terms enforce the ten year requirement? I wonder if EBR Motorcycles (the post-receivership company) didn't put something in the contracts with new dealers where they guaranteed they would support the new bikes for at least 10 years? You would think if this were the case, they'd be publicizing it to try to allay fears about the parts drying up and help move the remaining bikes. |

Well a bunch of parts are now obsolete. If you want to add a Ulysses cigarette power outlet to your bike, or buy valves for an 1125R your selection is going to be limited. None of the wear parts or consumables are obsolete yet as far as I know. |

I didn't mean to say that all parts are being made, only that new batches of some, such as the XB front isolator, are being made. There must be a deep mole Buell sympathizer that sneaks things into the system at HD. |

Mhpalin, the 1125 belts are not obsolete. 1125R belt is currently on backorder, and the CR belt is in stock in the US. |

Have you tried any other servicing Buell dealers? If not, here's the list of dealers in Canada that can get Buell parts: http://www.buell.com/content/buell/en_US/service-p roviders.html#countries=CAN |

Can we remember that they are in business to make a profit? What do you want them to do, sell it for a dollar because someone has a dream about making motorcycles? Of course they are going to mark it up double or triple and if we are lucky someone will buy it all (but I doubt it). |

"That's 2X what LAP paid for it!!!" Thats business. How do you think restaurants operate? Retail centers? They got it for a song and made sold some stuff and now are looking to cash in on their investment...good on them. America. Capitalism. Awesome |

If they can get that for it, more power to them. I'd just like to know where the figure came from. It does seem likely that if only 2 companies were interested at $2.2M, there's likely to be nobody interested at $4.5M. The auction items are listed in an interesting fashion though. If the only get say $2M in bids for the individual line items, you could theoretically bid $2.2M (plus the substantial fees) on the special "grouped" items and and get the whole company. They may be looking for $4.5M, but the listings imply they'll accept a lot less if necessary. |

"He Who Shall Not Be Named" won the original auction for EBR but his financing fell through due to uncertainties over what still belonged to Hero. LAP bid $2.2m at the second auction. "He Who Shall Not Be Named" also bid $2.2M, but wouldn't go higher, so LAP got it. IIRC the rules required each bid to exceed the previous bid by at least 5% so the judge awarded to LAP. When youre already at 2.2M, whats another 100k to get what you really want and follow through with your 'i'll do whatever it takes to get the company...' or whatever he was saying And then, of course, more of his, "Im under NDA with LAP..." chatter. Well we'll see what happens tomorrow when the auction starts |
