I never thought it would happen, not from a fellow Bueller! But it did. I purchased some parts from a fellow Badweb member with a Ulysses and the deal went bad for me. I won't mention the members name, that isn't what this is about. He knows who he is and how lame he is.

The details-

I posted that I was looking for a barricade Orange air box cover, fly screen, and seat in the classified section for the Uly I just bought. I thought the Barricade color is pretty hot and wanted to have two colors for the bike. A fellow member sends me a private message that he has some and wants to sell the parts. I asked THREE times the quality and condition of the plastics. Each time his response was "Perfect, not a scratch on them." So we negotiate a deal, and I send the money through paypal, a site that I believed to be secure and stand behind the buyer.

After 27 days without the parts, and with no response from the seller I opened a claim with paypal. The seller finally wakes up and ships my parts. Finally!!!

I get the box home (Box was partially crushed due to lack of support on the inside) open the box to see the parts that I had been patiently waiting for, and notice right away that the fly screen has so many swirls and scratches in it that I get dizzy. The air box cover isn't any better either! Now I'm pissed. The only packing is about three pieces of bubble wrap that might be 2 foot by 1 foot. For about $150.00 more I could have had BRAND NEW parts!

I attempted to negotiate with the seller but he says no refunds, no discounts. Now the dude tells me I'm beat, that buyer beware, and he told me the year that the parts came off of. Can you believe, he actually said buyer beware!!! That is why I asked THREE times the condition!!! ( The bike is a 2006 which I was informed had less than 1500 miles on it, and again his words "Perfect, not a scratch on them."

So I try to escalate the issue with paypal and they tell me that they do not cover such claims since the product was not purchased through Ebay.

Great... just F@#king great. Now I'm stuck with these scratched up pieces of crap!

Guess what... Not with American Express... this is my next step!

This wasn't meant to be a sob story, just venting some frustration, every other Badweb member and sponsor that I have dealt with has been great. Just be careful when buying something online with paypal that isn't through Ebay.

Any members in North Carolina want to pay this guy a visit... I'd be happy to compensate.

Scotty,

Before picts would have been a good idea. I took his word for it that they were in great condition.

I'll take some pictures tomorrow and see how they come out. I am not sure how well the pics will detail the scratches and swirls. It will at least show the crappy packaging.

Here is the text from the email. The beginning of the conversation is at the bottom, so you have to read it backwards, bottom first.

OK xxxxx,

Sorry for the delay, I was out of town and had some issues at my business
when I returned.  I am ready for the stuff.

Just to be clear for both of us the stuff is off of a 2006, in great shape
with no to very little marks/scratches.  I understand the seat scuff.

You can send me a paypal invoice to xxxxt@xxxx.com.

Thanks for waiting.

Scott

_____________________________________________

As you can see, I asked THREE times the condition. First time he responded-

"the plastics are perfect. No scratches or bugs dings. Decals are perfect. The orange of the seat is perfect but the very first time I
threw my foot over the seat I made a scuff on the black part. Its almost buffed itself out with my butt though.
The bike only has 2600 miles. So it really is all good."

That would lead me to believe that there are NO scratches in the plastic.

Second time I asked the question there was no response.

Third time I asked the question I asked, "Just to be clear for both of us the stuff is off of a 2006, in great shape
with no to very little marks/scratches.  I understand the seat scuff."

His response-
That's correct. Will do. Thanks for getting back to me. "

Does anyone know any way I can actually post the entire email. Print, scan and post it maybe. I want everyone to believe what I am saying. I even offered to pay to ship the stuff back if he would refund my money... he said "Nope" Bastard. Am I nuts here, or should the stuff have been in "Perfect" condition like he said!

I will share his name if he doesn't come clean, I am still (Like the jackass I am) giving him the benefit of the doubt.

Orange hides scratches pretty well, just keep it filthy. Works for me : )

Seriously though. Get either some Novus polish, or grab a CD/DVD scratch repair kit that has the liquid 'scratch filler' stuff. It works wonders with a little elbow grease.

You are correct,
you can find it under the classified section,

parts and accessories wanted.

"Looking for Barricade orange plastic and seat for a Uly."

oops... That didn't make it too obvious did it?

Light swirls are normal wear and tear for bodywork with 2600 miles on them. Perhaps it was bad of him to say perfect, but without seeing pictures, it probably is about as good as you are going to get without buying new. Try the Novus polish like others have said.

I agree with the Novus polish. Maybe give it a try.
Many people have different definitions of perfect. To me perfect means "as new". But I've heard so many. There is perfect as in new, perfect for 2000 miles, perfect for the age of the bike, etc. Sounds like there is a little more to it than that now though. Obviously this has gotten ugly now between the buyer and seller. Maybe the seller is watching this thread (I'll guess yes). If so, hopefully both of you can figure something out and make this right.

Froggy,

I'll take some pictures and hope they come out so you can see the scratches. I have a lightning with close to 10k on it and the plastic looks 100 times better than this. I would understand some minor stuff, this is just way worse than that for something described as "Perfect"

Dentguy,
I also agree that there may be a difference in perception of new, but not looking like someone took steel wool to it. he explained a small scuff in the seat that is 100 times less obvious than the swirls/scratches in the plastic. My perception is realistically "almost" new. Some people are more anal as to how that take care of there stuff. Perfect might just mean perfect as new, but I am a realist and expected some light issues. I just hope the the picture comes our without too much glare to show the marks.

The F'ed up thing is I even offered to pay the shipping to return it to him, would have cost him nothing. I don't know about you guys, but if I sold anything to someone and they were not happy with it and offered to pay to return it for a refund, I would do it. I couldn't have been much more fare.

This wasn't to bash a member, I just wanted people to know to be ware, and that Paypal doesn't stand behind anything that wasn't bought off of Ebay.

Unfortunately I will be much more leery when buying something next time.

That is the F'ed up thing. I don't think you can be any fairer than to offer return shipping for a refund on something that wasn't delivered as described.
I bought some used Ducati items a while back (bars and risers). The bike they came from had been down, but I was assured they weren't bent. When I got them they were tweaked a little, but the risers were OK. Same kind of deal through Pay Pal without E bay. He said he didn't know they were bent (I believed him) and told me that he didn't actual measure them. He offered a full refund or half the money back and I keep them (which I did). It's the right thing to do, but unfortunately not everyone is like that. Hope things work out.

Peter Egan has an interesting story about seller descriptions in his "Leanings 2" book. (Going +1 on Dentguy's post as to subjective "perfection").

Look under "Leading the Witness" pp 67 in vol 2.

This isn't the fault of the shipping company, but the crap packing job from the seller. Can anyone else see why I am a little pissed. For about $125.00 more I could have bough brand new parts in a factory carton.

By the way, I have officially called the seller out on this matter and sent him a PM with a link of this post. just incase he had not already seen it before and felt too small of a person to respond.

Life is short. Take an hour and polish the things and ride. Live and learn. Seriously, this is NOT worth the time and effort that you are investing. Look to the positive. Life is WAY too fleeting to get stuck on such trivialities. They mean nothing. Literally nothing, zero.

Blake is right.
The parts probably got scuffed in shipping.
I've had worse deals happen from eBay auctions. You can polish them up and enjoy how they look on your bike; or, if you just can't accept them, then put them up for sale.
Either way, how important is it?
